IHC rejects petition calling for resignations of PTI MNAs to be accepted

ISLAMABAD: The Islamabad High Court (IHC) rejected on Monday a petition calling for resignations of Pakistan Tehreek-e-Insaf's (PTI) members of the National Assembly to be accepted, Express News reported.

In its short order, a two-member bench, headed by Justice Athar Minallah, termed the petition non-maintainable.

Pakistan Muslim League-Nawaz's Zafar Ali Shah, in his petition, claimed that the return of PTI members back in the assemblies was illegal, and, thus, requested the court to accept their resignations, and hold by-elections in the respective constituencies.

Shah has named the federal government, the National Assembly speaker, the Election Commission of Pakistan, leader of the house, leader of the opposition, PTI Chairman Imran Khan, and all PTI MNAs as respondents in the case.

The petitioner stated that PTI MNAs had voluntarily tendered their resignations, and the Constitution of Pakistan was very clear on the subject. He maintained that once an MNA resigns from the assembly, he is no longer a part of the lower house.

PTI members had resigned from the National, Punjab and Sindh Assembly after a conflict with the federal government to form a judicial commission to investigate alleged rigging in the 2013 general elections.

Following a 126-day sit-in in Islamabad against the government, a judicial commissionwas formed earlier this month to probe rigging allegations, following which, the PTI returned to Parliament and the provincial assemblies.
