Rs1b defamation case: Imran Khan withdraws revision petition

PTI chief had filed against district and sessions court’s ruling in PHC.

PESHAWAR: Pakistan Tehreek-e-Insaf (PTI) Chairperson Imran Khan withdrew his revision petition on Friday in the defamation case filed by Qaumi Watan Party (QWP) former provincial minister Bakht Baidar Khan.

The petition had been filed at the PHC against an order of the district and sessions court that dismissed another petition by the PTI chairperson. Imran’s earlier petition had stated the QWP leader’s Rs1 billion defamation case against him was not maintainable.

Justice Irshad Qaiser and Justice Musarrat Hilali were informed by Imran’s counsel Qazi Muhammad Anwar about the withdrawal on Friday. The court accepted the request and the petition was disposed of.

Maintainability

The key reason for the withdrawal was a violation of legal modalities.

The original petition against maintainability was submitted while the case was already sub-judice. On April 1, 2014, the then district and sessions judge Shaiber Khan had rejected Imran’s application. Imran then approached the high court against the dismissal order after which the district and sessions court was restrained from passing any verdicts in the case on April 24, 2014. The case will now be able to proceed in the district court.



Bakht Baidar had filed an application with the district and sessions court last Saturday, requesting it to expedite the pending defamation lawsuit’s proceedings.

Imran’s revision petition at the PHC stated the lower court had erred in its decision (to find the case maintainable) and thus the damages suit is not maintainable. His counsel had informed the court that the QWP leader was sacked on charges of corruption by K-P chief minister and not Imran Khan himself; that too after repeated warnings about irregularities.

In a written reply submitted, Imran had maintained he stands by any comment made by him on a public forum or the media regarding the sacking.
