Illegal construction: Court orders KMC to remove encroachments from Clifton park

KMC authorities claim the construction is illegal as no permission was sought to raise them

KARACHI: The Sindh High Court (SHC) ordered the Karachi Metropolitan Corporation (KMC) and police to remove illegal constructions on a public park in Clifton Block 2.

The bench, headed by Justice Sajjad Ali Shah, also ordered the KMC legal officer and the Boat Basin police station's house officer to file compliance reports by December 2.

A non-profit organisation had filed a petition in the court that a Kennel club is being built on a portion of an amenity plot No. ST-9 reserved for the public park. On the other portion, a mosque and seminary are also being built, he added.

The petitioner alleged that hate speeches are being delivered at the mosque in the area, where the followers of different sects of Islam and other religions live. The petitioner argued that the constructions are entirely in violation of the law, as the amenity land cannot be used for any other purpose except for what it was originally earmarked for in the master plan.

On Wednesday, KMC's legal adviser claimed that the construction was being carried out on the public park without any authorisation. Advocate Afsheen Aman, who appeared along with the deputy controller of buildings of the Sindh Building Control Authority, stated that no approval had been obtained from the SBCA before raising the constructions by the respondents.

The two judges thus ordered the Boat Basin police station's house officer to ensure that no construction of any nature be raised on the park. The bench also directed the KMC to ensure removal of the structures.

KMC's lawyer Syed Sultan Ahmed pleaded to the court to issue necessary directions to the South district's municipal corporation to provide requisite assistance for the removal of encroachments. The bench directed the KMC South to provide necessary assistance to remove the encroachments and ordered all relevant officials to submit their compliance reports by December 2.
