Legal morass: Lawyers prepare to challenge SC’s 2009 ruling

As the Supreme Court hears former military ruler General (retd) Pervez Musharraf’s review petition on January 28 against the court’s July 31, 2009 judgment, the superior court bars have also decided to challenge the same decree with regards to the removal of more than 100 judges.


Senior members of the bars revealed to The Express Tribune that superior court bars of all provinces would challenge the 2009 judgment, adding that the Lahore High Court Bar Association would file the review petition before January 28.


More than 100 superior court judges were removed in July 2009 as 60 judges faced contempt proceedings for violating the November 3, 2007 order on the promulgation of Emergency Rule and the Provisional Constitution Order (PCO).


LHCBA president Abid Saqi confirmed that the high court would move the review petition on behalf of advocate AIi Zafar, son of senior lawyer S M Zafar. This petition will then be heard along with Musharraf’s case next week.
