The Supreme Court upheld the Sindh High Court (SHC) decision.
Last year, on December 25, 20-year-old Shahzeb Khan was gunned down by Shahrukh Jatoi, who was accompanied by his friends, Siraj and Sajjad Talpur. The young men had a fight after the Talpur’s servant, Ghulam Murtaza Lashari, teased Shahzeb’s sister.
The SHC was expected to take up for hearing the appeals filed by four convicts in the murder case along with the compromise application filed by the victim’s family on September 20.
On September 17, the court’s bench had removed the primary objections raised on the compromise application filed by the parents and the two sisters of the victim.
On September 9, Shahzeb’s parents – DSP Aurangzeb Khan and Ambreen Aurangzeb – had decided to pardon the culprits in the “name of Allah,” without claiming the amount of Diyat or Qisas.
An ATC had handed death sentences to main accused Shahrukh Jatoi and Siraj Talpur and life-long jail terms to Sajjad Talpur and Ghulam Murtaza Lashari on June 7.

In the "west" this case would have been investigated thoroughly in the first place - not had people go to the media and on the internet accusing first. Oh that's right - in the western world this isn't allowed - this is called defamation/slander/libel.
Refer to MLO's testimony whereby he stated under oath in Court that the two bullet wounds were not fatal - but that moving someone with a fractured spine is. And the fact that Shahzeb was moved from the car BEFORE proper medical attention arrived to care for his injuries. Shahzeb could have survived.
This is the reason that now I believe that the western laws are better than the Islamic laws. THe culprit gets punsihed in the west no matter what. There is no such thing as forgiving the killer in the name of God. If you commit a crimne in west, you will be punished by the court, period.
Even if forgiven by the family of the murdered victim had humbled the killers and his family to correct their path and be remorseful, it would have been looked upon. But here these arrogant killers and their family is mocking the Judiciary and making victory Sign with mocking, clapping and humiliating the Judiciary are not really planning to live peacefully when released back again. It's a moment for the Feudal and the Powerful to consider the change the society is going through that they have not taught their kids in childhood.
NO rich will dare to kill middle class and poor any more.. we all safe..
@Jibran: For one who knows the ground realities of the justice system I did not expect you to say that.
Either I am too dumb to understand this article or this article is not very clear. I fail to understand if Mr.Jatoi is forgiven by Mr.Shazeb Khan's parents because of this stupid law called Diyat or Qisas, then why is he appealing the case to be transferred to sessions court from the Anti-terrorism court (ATC). I think this law Diyat or Qisas could have been applicable 1,500 hundred years ago but not in the 21st century, today any crime committed in the civilized countries are considered crimes against the State or people. Personally I would like to see all of them given life sentence WITH OUT ANY PAROLE, let them think about what they have done for the rest of their lives and make them an example that money can't buy everything even in Pakistan.
I'm now fed up of this case. Not sure what SC is going to milk out of it. Everyone deserves a fair trial, and trying this case under ATC does seem wrong.
Now please apply this principle to Mr Arsalan Iftikhar Chaudry also.
Goes to show that loopholes exist even in Shariat laws. The powerful can bypass ANY law - man made or otherwise.
If you are rich and powerful you can commit murder and go free in Pakistan ............. this common saying has been proved FALSE IN THIS CASE..... thank you CJ.
We will get out of this one - like always. If we were to be punished, we would have been already. This is true justice - might is right !
Why do not judges apply same laws when they release known terrorists and sectarian killers?
This is the difference between religious laws and secular laws. In Holland one does not understand the concept of diyat or forgiving in the name of Allah (or any diety for that matter).
Here even if the culprit is 'forgiven', he/she will still be prosecuted bacause its a crime against society.
