
A sessions court dismissed a criminal appeal on Tuesday and upheld the sentence of year-long imprisonment awarded to a contractor, Muneer Ahmed.
Ahmed, who worked for the Sindh Government Works Department, was accused of occupying the flat of the complainant, Jamil Ahmed, located near Shumail View, Gulzar Hijri. The court acquitted Ahmed’s wife, Shahida, who was also convicted in the case because no evidence was found against her.
The first civil judge of district Malir had convicted the appellants under section 448/34 of the Pakistan Penal Code on November 12, 2011. The appellants challenged the decision. The advocate of the accused convinced the court to turn aside the previous verdict which also sentenced Shahida. According to the prosecution, the complainant had allowed the couple to move in because their house was under construction. The couple refused to vacate the flat when asked and handed over its possession to some other people.
After hearing arguments from both sides, the first additional district and sessions’ judge, Malir, Sadaf Asif, upheld the sentence against Muneer. The accused, present in the court on bail, was remanded to judicial custody to serve the sentence.
