Judges detention case: Prosecutor a no-show at the hearing

The hearing of judges’ detention case against General (retd) Pervez Musharraf in Anti-Terrorism Court (ATC) on Tuesday was adjourned without progress as the prosecutor refused to appear citing personal reasons.


The investigation officer (IO) informed ATC Judge Syed Kausar Abbas Zaidi that prosecutor Syed Muhammad Tayyab was reluctant to appear for the hearing. The case was adjourned till May 18.

Syed Tayyab told The Express Tribune that his mother has been hospitalised due to which he cannot pursue the case.

Previously Raja Rizwan Abbasi, who was engaged as a lawyer by Musharraf, had disassociated himself from the case. Later Musharraf had engaged his new counsel Ilyas Siddiqui.

The case is based on an FIR which was registered against Musharraf on August 11, 2009 by the Secretariat police for detaining over 60 judges including Chief Justice Iftikhar Muhammad Chaudhry.

Every thing is done in the national interest. Elected government is toppled in the national interest. NRO is promulgated in the national interest. Musharraf ordered the detentions of judges in the national interest. Treason charges against Musharraf should not be pushed in the national interest. Taliban and or extremist pursuing to impose their ideology should be accepted in national interest. Who is deciding this national interest. Will it not be to re accept the law of necessity declared by Hon'ble CJ to support the army general's coup and later repented for it
