ISLAMABAD: The November 3 emergency was imposed on the orders of then Prime Minister Shaukat Aziz, former president Pervez Musharraf’s lawyer claimed during the hearing of treason case held on Tuesday at the Supreme Court, Express News reported.

Musharraf’s counsel reiterated his reservations regarding the bench hearing the case.

The former president has doubts regarding Justice Jawad S Khawaja, who is heading the three-member bench, Musharraf’s lawyer Ibrahim Satti said during the hearing of treason case.

Reminding the court of the time when the chief justice of Pakistan (CJP) had blamed the Supreme Judicial council of being partial when he was detained, Satti said that his client also has similar reservations regarding this bench. Hence, their request for full bench should be taken seriously.

Earlier, Musharraf’s team had requested for a full bench (minus the CJP) for this case.

Justice Abdul Hamid Dogar had verified the November 3 emergency but the ruling passed on July 31, 2009 changed it, Satti further argued.

SC, in its July 31, 2009 judgment on a petition filed by the Sindh High Court Bar Association, held Musharraf responsible for violating the Constitution and observed that it was the federal government’s task to initiate the former dictator’s trial.

“Do you want court and parliament to verify the unconstitutional steps taken by every government?” questioned Justice Arif Khilji in reply to Satti.

Musharraf escape case: IHC orders action against IG Islamabad within 24 hours

The Islamabad High Court (IHC) ordered action to be taken against Inspector General (IG) of Islamabad Police Bin Yameen within 24 hours for letting former president Pervez Musharraf escape from court premises, Express News reported on Tuesday.

During the hearing, Additional IG Operations Sultan Taimuri submitted a report to Justice Shaukat Aziz Siddiqui stating that SSP Operations Yasir Farooq had ordered 40 police officials to arrest Musharraf but there were only three officials present in the court when the ex-president escaped.

The additional IG also said that the DSP Secretariat was not performing his duty at the premises, and 140 Rangers officials had cordoned the court premises off at the time of the hearing.

The report added that SHO Secretariat Qaiser Gilani was held responsible for Musharraf’s case and was issued a show-cause notice, while DSP Secretariat Idrees Rathore was suspended from his duties for showing negligence.

The court remarked that the suspended constables have been reinstated by the interior ministry, and it was IG Islamabad who was responsible in the case.

Justice Siddiqui said that the IG Islamabad was lying to the court and action should be taken against him in 24 hours for deceiving the court.

The additional IG assured the bench that the caretaker interior minister will ensure that the court’s orders are implemented as soon as he returns from Karachi.
