Temporary reprieve: IHC stays Syrian student’s deportation

The Islamabad High Court (IHC) on Wednesday extended a stay order restraining the government from deporting a Syrian student back to the Arab state.


Chief Justice Iqbal Hameedur Rehman extended the order after representatives from the interior and foreign ministries failed to submit replies before the court on why Yoman Ismail, who was detained by security agencies in 2010, should be deported.

The court adjourned till the next hearing, a date for which will be set by the registrar’s office.

In the last hearing, the defence ministry informed the court that he was being kept at an internment centre in Khyber-Pakhtunkhwa (K-P) after he overstayed his visa.

On December 17, the CJ granted a temporary stay order holding off Ismail’s deportation to his home country and issued notices to the interior and foreign secretaries for December 19.

Bilal al-Samawari, a friend of Ismail’s, filed a petition before the IHC on October 26, 2012 challenging his friend. Ismail’s counsel had informed the court that the detainee was an LLM Shariah and Law student at the International Islamic University Islamabad who went missing in 2010. Later, security agencies informed the court that they had taken him into custody after finding he had overstayed his visa.
