The best thing about the army is its institutionalised system of justice and accountability, as well as the across the board system of benefits and punishments that exists at all levels of service. An army that has a system of justice that awards the sword of honour to the son of a coachman (kochwan) and 30 years later, makes him a general as well, cannot be prejudiced. Similarly, an army that holds serving generals accountable and knocks out strong serving corps commanders, like Lt-General Tariq Parvez Khan and Lt-General Hameed Gul for lapses in discipline, cannot be discredited and accused of sheltering retired generals.
Traditionally, generals in the army are not punished for lack of competence, neither for exhibiting dissent, nor for policy failures or even for failure to implement a military strategy; a general is mostly punished when found guilty of making bad judgments that result in poor decision-making. Such decisions, when implemented, lead to negative consequences that cause individual, institutional and national humiliation and disrespect. It is up to the government to take such generals to task. Trying any retired general in civilian courts is not an institutional insult but a national obligation. This would do more good than harm to the army as an institution. It will also promote justice and the rule of law in society and would be a vital step towards ensuring military subordination to civilian authority.
The case of the army’s premier intelligence agency, the ISI, is quite different. It uses clandestine and covert methods to achieve its goals. It is referred to as a ‘secret service’ because of the nature of its job, which is not only about getting battlefield information, but is also about doing the state’s dirty job. It is designed and structured to execute unlawful missions like any other intelligence agency in the world — all in the name of ‘state interest’. Therefore, can it be expected to operate under the law? Should the law prosecute it? Or should the role of an agency change from undertaking covert to overt operations? Aren't the agents of intelligence agencies the world over operating in hostile territories seeking information on the enemy’s capabilities and intentions? Is this not unlawful? Should the law hold intelligence agencies accountable for this as well? Is a court entitled to question the ISI on how many of its secret agents are operating abroad and is the agency supposed to share this information with the court? If not, then it is in this context that intelligence agencies, due to the nature of their job, have almost an unwritten immunity to law all over the world and the ISI should be no exception.
What has given a bad name to the ISI is not its operational incompetence, but its overindulgence in politics of the state. Reforms, if any, in the ISI will not come through court orders; they may, however, result through the ongoing process of democratisation and the supremacy and rule of parliament. General Ashfaq Parvez Kayani may have offended many people with his recent forceful address but even his severest critics would agree with him when he says, “All systems in Pakistan appear to be in a haste to achieve something, which can have both positive and negative implications.” The big question today is, will the state of Pakistan be able to absorb the consequences of the currently 'extremely active' judicial activism? Only time will tell.

Guys! please be respectful to each other. Don't let your emotions go out of context. However, in my humble opinion and being closely associated to Army fellows in my family, I am sure that me & my cousins working in multinational IT/Telecomm firms & Hospitals do make nearly 7-8 times salary a month as compared to the Army ones and believe me, those in Army are more capable and professional individuals, i.e. Engineers, Doctors. Let's respect each other for what we all do. A subsidized plot with meager salary with serving the country for decades at tougher cities is not that big a luxury. Let's be generous in praising as well. Thanks.
@usman Why plot has been made an issue, it has nothing to do with the article.We should be gentle while giving comments words like fool does not fit in th ethings.One must argue on points and convince or get convinced. The fact of the matter is that you or any body else has no right to bring in disrepute the army as an institution. Cite any example from rest of the world where army is discussed. Yes if a general has done something wrong he should be punished like others, I am with you but don't talk about plots for which the officers make payment.Basically these are welfare projects because you retire at much younger age. Let us not undermine their sacrifices that is helping you to have sound sleep and write anything against them. You must remember one thing if Pakistan is there we are all there , if it is not there some one else will be there so what is the option to respect army
Just for your information selection of army officers is so tough that out of 15000 candiadates hardly 120 can qualify and it includes sons of cobler, coachman, chowkidars, teachers,clerks etc, that is the beauty of this army Pl respect them

Coming from a retired army man its a fair opinion piece. I don't think and I am sure the common man does not think it's fair that the army as an institution should be 'put in the dock', for the doings of a few generals (and that to retired).

No doubt, military service is considered to be the most disciplined service in the world. But the Military there respects & obeys the Law of Land.... USA is in the middle of war but General David Petreus and General Allen have shown full respect for their country and happily retired after the scandal. In India, General V.K. Singh has quietly retired when Supreme Court decided against him. Turkish government has thrown Army Chief Ilker Bazburg behind the bars for his nefarious design to overthrow an elected government. Along with him some 200 senior officers of Army, Navy and AirForce are being tried for violating the Law and hatching conspiracy against the government. Sri Lankan government jailed General Sarath Fonseka when his political ambition was uncovered. For God sake, don't tell us that all these countries have no institutionalised system of justice and accountability!!!

Sir, the functions of this army are no different from any other so please explain the special affection. Also in every country the personnel of the Intelligence services can be prosecuted for breaking the law of the land, no matter how noble the objectives -- this includes making people disappear and indulging in other criminal acts. I do not know if any country where the accounts of the Military and Intelligence services are not audited ----- would you have a valid explanation for it ?
@Mukhtar and Usman: Plots in DHA you say, where does the land come from to begin with? Landgrabs no less, and given off as you say at subsidised prices. As for service in Siachen, why then do officers only recieve plots? Are jawans who serve in Siachen less worthy? Is this the best argument that you can offer? That soldiers are serving in Siachen, so we should look the other way as Generals caught up in NLC scam, deals with Malik Riaz, Royal Palm Golf course and manipulating politics should get off scot free?

Second, plot given by army in DHA are purchased at cheap rates since they are away from populated areas of cities and takes decades to reach a crore. Thanks to fools like you who have even raised price of DHA City Karachi, 40 km from Airport, in millions. its the sheer hard work and trust in DHA which compels people like to live in peace there. Army did what it felt right at that time. this may seem odd, But those Generals were send home for meeting the PM without permission of COAS and refusing to go on new assignment to Chairman POF wah. Had the corruption was intent, General would have enjoyed his stay in Wah. Sometimes they act like Sikhs and they have to be this way otherwise a burger and west educated would never join army what to talk of getting the bullet on his chest. It is performance based unlike PM alloting plots to politicians, judges, friends.All pay for it and nothing is free.Soldiers spend two years in Siachin and other borders how many of you would be willing to come and join them with such small package,None.Due credit must be given to soldiers who opt the most difficult profession in the world.
Critisizing your army simply means you are weakening the country. What is happening in the country it is provincial and federal government's responsibility.Yes army can be called in aid of civil power under article 245 of the constitution but requistion must come from the government, they do not move at their own, if they move at their own no one would like it
