The PML-N senator alleged that a large number of MQM members of parliament and provincial assemblies were dual nationality holders and requested the court to disqualify them.
Senator Shah named MQM chief Altaf Hussain, Sindh Governor Ishratul Ibad, elected members of MQM, Election Commission of Pakistan (ECP) and Pakistan Electronic Regulatory Authority (PEMRA) as respondents in the case.
He asked the court to remove Ibad from his office of governorship since he stood disqualified under Article 63 (1) (c). Shah asked the court to declare the Sindh governor’s appointment notification null and void and unconstitutional because “he is holding office for the last 12 years” though he is a dual national.
Referring to the MQM chief, Shah raised questions whether it was legally and constitutionally correct and possible for a person possessing dual nationality and living abroad to obey and face the laws of Pakistan while he acts as a party head. He asked if such people can effect and command the process of law making in Pakistan.
He said that all members of the MQM should be asked whether they “want to remain under the command and control of Altaf Hussain or under the command of the Constitution of Pakistan”.
Senator Shah further asked the court to direct Pemra to not allow or facilitate – through broadcasting and televising – Altaf’s speeches.
