SHC restrains Clifton Cantonment Board from finalising tenders

The petitioners said that they had been barred from taking part in the bidding process.

KARACHI: Justice Muhammad Ali Mazhar of the Sindh High Court restrained Clifton Cantonment Board on Friday from finalising a tender for Conservancy Services till August 9, when the bench would be hearing a recovery suit filed by a company.

The petitioner company, Saleh Brothers, filing the suit through their counsel Shoua-un-Nabi advocate, maintained that their contract would expire on August 18, 2012 and the cantonment board had initiated the process for new contract through tenders.

The plaintiff company was earlier fined by the board to a tune of Rs20 million on different pretexts and later it was barred from taking part in the tender process. When the plaintiff company officials reached the place for submitting tender, four armed guards of the cantonment board prevented them from entering the premises.

The matter was then brought to the knowledge of the high court which in a suit filed by the plaintiff company, ordered that Saleh Brothers be allowed to participate in the tendering process and that tender shall not be finalised till further orders.

After hearing the counsel for plaintiff company, the bench adjourned further proceedings till August 9 and restrained the Clifton Cantonment Board from finalising the tender.
