PM's role to appoint judges cannot be restricted: Khosa

Justice Khosa observed that the role of the PM with regard to the appointment of judges cannot be restricted.

ISLAMABAD:

Justice Asif Saeed Khosa on Wednesday observed that the role of the prime minister with regard to the appointment of judges cannot be restricted.


Justice Khosa was hearing the 18th amendment case in the Supreme Court.


Durnig the hearing, Additional Attorney General K K Agha said that amendments can be made to the preamble of the constitution, because the changes in it do not supercede the constitution.


But Justice Jawad S Khwaja did not agree.


Meanwhile, federation's lawyer Zafarullah Waraich said that Article 63-A has been inducted in the constitution to stop a change of loyalty.


But Justice Tariq Pervez raised questions about why political parties' presidents have now been empowered under the 18th amendment to take action against those who change their parties.
