Objectives Resolution integral part of constitution: CJ

The Chief Justice said that no one has ever tried changing the Objectives Resolution.

Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry said that the Objectives Resolution is an integral part of the constitution and no one has ever tried changing it.


The Chief Justice made this observation while hearing the arguments in the 18th amendment case.


The federation's lawyer KK Agha pleaded before the court that the Objectives Resolution cannot block amendments. He said there is no basic structure of the constitution.


Justice Jawad S Khwaja observed that the Objectives Resolution has been accepted as part of the constitution. He said freedom of judiciary is a vital organ of the Objectives Resolution.

hakeem | 14 years ago | Reply @cmsarwar 1- you may be right about politicians but instead of wasting our energies on reforming individual politicians why not educate people of pakistan to elect better representatives. If poor sheeps wont then none can stop the music. If you choose democracy than its all about believing that good things happen through elctoral process and not through benches or baracks. 2- About religion Iftikhar Ch.and his most trusted Ramday may be religious people individualy but when in capacity of judges they must not bring religion as a sheild of their acts. I mean Pakistan is Islamic Republic no doubt but on the other hand religion is very tricky and slippery topic in Pakistan, System in pakistan cannot afford to let mullahs reject legislations and judgments because according to their version its not islamic. Instead what i understand by Islamic Republic it simply means to proclaim that we are a muslim majority state nothing more nothing less. 3- When i mentioned about injustice i dint mean anything regarding NRO cases etc instead i am witness of injustice by delaying tactics with some common pakistanis and that by current S.C. itself. 4- About power games when you say that they are choosy in setting prefrence of cases to be taken, it proves power playing. And the unneccessary stubborness shown in the case Punjab's high court chief elevation, what was it if not show of power. Lastly i once again say that it will take time till CJP is exposed... but untill then i have no right to snatch your entertainment you take from remarks of Clown Judges
cmsarwar | 14 years ago | Reply @hakeem.From various reports I gather both the Justices(Iftikhar and Ramday) are personally very religious .But Supreme Court is not just these two judges.And everybody is entitled to his religious beliefs and practices.I am really distressed that you are disillusioned with the judiciary although you contributed quite a lot in the movement for its restoration .I agree with you that our judiciary is not perfect but I am not aware of any power games being encouraged by them.I ,however,wish that our superior courts should be visibly more even-handed in taking up for consideration various well-known and important cases and demonstrate that they are doing across-the -board justice and not focused on a particular segment.Meanwhile,I must say that our elected representatives have to be very responsible and perform better in order to forestall any adventurism which sabotages our political structures.Last time it happened (Musharraf's coup) was because we had a Prime Minister who was really very foolish.Not that it justified a criminal taking over the country which, later on ,Musharraf turned out.While I have full faith in superior judiciary I am apprehensive that our current rulers are not doing well.And further bad news is that the alternate to them is the same player who was removed by Musharraf,concerned more with his business empire than the welfare of the nation.Any power game if it happens will,as usual,be facilitated by our politicians and not by the current judiciary.
