Mother wins back custody of children

Her ex-husband had kept the children, threatened her against approaching the court.

A woman regained custody of children from her ex-husband.


Ishrat Yasmin, a resident of Sikandarabad, Rawalpindi, had moved the Islamabad High Court (IHC) for the recovery of her children, whom her ex-husband had forcibly detained.

The IHC Chief Justice, Iqbal Hameedur Rehman, on Wednesday ordered that the three minors be handed over to their mother. The police produced them before the court through a special court messenger.

Waqas Chaudhry, representing the petitioner, maintained that his client was married to Azhar Hussain and had three children — Saleha Noor, Tayyaba Noor, and Mah Noor.

He said that with the passage of time, Hussain’s relations with his wife worsened. In July he left his wife at her parent’s home and kept the children with him. He divorced her soon after.

The counsel maintained that his client had filed a suit before the family court accusing Hussain of victimising her and forcibly took away the children.

Chaudhry informed the court that Hussain turned down repeated requests by his client’s family to return the children and even threatened of “dire consequences” if she filed a complaint for their recovery.

He contended that Yasmin had filed an application before the sessions court, but it was dismissed in October, leaving her with no option but to move the IHC.

He informed the court that the sessions court order was illegal and against the welfare of the minors, because they need proper attention of their mother.
