Olivier Martinez challenges Halle Berry’s daughter’s role in custody dispute
Martinez says his 13 year old son wants the court to hear his account of an alleged September incident

Olivier Martinez has asked a judge to prevent Halle Berry’s 18 year old daughter, Nahla Aubry, from becoming involved in the former couple’s custody dispute over their 13 year old son, Maceo.
According to court documents reported by Us Weekly on October 12, Martinez argued that Nahla has no significant bearing on the case and is biased. Nahla is Berry’s daughter with her former partner, Gabriel Aubry.
In a sworn statement obtained earlier this month, Nahla said she had never seen her mother hit, slap, choke, grab or physically abuse Maceo. She also stated that she had never witnessed Berry act violently towards anyone during the years she lived with her.
Martinez, however, has argued that Maceo should be allowed to speak to the court about an alleged incident on September 26. He claimed his son wanted to share his account and that his testimony could help the judge establish what happened.
The dispute follows Martinez’s request for a domestic violence restraining order on behalf of himself and Maceo on October 1. He also sought an emergency change to the former couple’s 50/50 custody arrangement and requested a temporary no contact order against Berry ahead of a court hearing scheduled for October 16.
Martinez alleged that Maceo told him during a telephone conversation on September 26 that Berry had physically attacked and choked him during an argument. These claims have not been established as fact in court.
Berry’s attorney, Marina Beck, previously rejected the allegations, describing them as meritless and misleading. Berry’s legal team has argued that the case concerns the actor’s efforts to protect her son’s wellbeing and secure appropriate support for him.
In his latest filing, Martinez also claimed Maceo feared that nobody would believe his account over his mother’s. He alleged that the teenager took a photograph of Berry after the incident in an attempt to document what he said had happened.
The former couple’s custody dispute remains ongoing, with both sides presenting conflicting accounts.
