Taylor Swift is continuing to face legal proceedings linked to her album The Life of a Showgirl as a trademark dispute with Las Vegas performer Maren Wade develops in court.
Wade filed a trademark infringement lawsuit against Swift in March, arguing that her federally registered trademark for Confessions of a Showgirl was negatively affected by Swift’s album branding.
According to Wade’s legal team, the U.S. Patent and Trademark Office declined Swift’s application to register the album title because it was considered too similar.
The case has recently seen new legal filings, with Wade requesting an emergency moratorium on merchandise sales linked to the album while proceedings continue. A judge has not yet ruled on the request.
Swift’s legal team argued against the proposed ban, stating that the album title qualifies as protected artistic expression.
Attorney J. Douglas Baldridge said in court, “This is the rare and special circumstance of an album — a classic expressive work. That’s why the First Amendment applies here. That’s why you can’t get a preliminary injunction.”
Baldridge also argued that Wade would need to prove consumers believed her work was connected to Swift in order to justify the request.
“I don’t see how that could ever happen,” he said. “For them to prevail, it’s not realistic.”
Wade’s lawyer argued that the trademark had identified Wade’s brand since 2014 and claimed online search results now direct attention towards Swift instead.
“Since 2014, that mark has identified one person,” Wade’s lawyer said. “Today, [Wade’s] mark no longer points to [Wade.] When a consumer types her exact registered mark into Google, autocomplete suggests [Swift].”
Swift’s lawyers also argued that Wade benefited from publicity surrounding the album release.
The legal developments come amid continued public discussion surrounding Swift’s wedding plans with NFL player Travis Kelce.
