PTI moves PHC for holding K-P elections

Says polls have to be held within 90 days of dissolution of assembly

The Pakistan Tehreek-e-Insaf has approached the Peshawar High Court to hold the provincial assembly elections within 90 days.

In a writ petition filed by the PTI through Advocate Moazzam Butt, it has been stated that elections must be held within 90 days after the dissolution of the assembly.

The Election Commission of Pakistan has written to the governor for the date of the election but the governor has not yet given the date which “is an unconstitutional and illegal move”.

The petition stated that according to the law, it was the duty of the government to supervise the election within 90 days after the dissolution of the assembly. “The governor said that we will take the report from the agencies and then give a date.

“Everything is clear in Article 5 of the Constitution that election is mandatory within 90 days.” It was requested in the petition that the court should issue orders to the governor to announce the date of the election.

Later, while talking to the media, former provincial minister Atif Khan said that it was a constitutional requirement to hold elections on time. “It is in the Constitution that elections have to be held within 90 days after the dissolution of the assembly.

“So far, the governor has not given a date, it is unconstitutional. Is. I don't know why PDM is running away from the election.”
