IHC CJ says court cannot interfere in administrative affairs

In a case related to the Pakistan Tehreek-e-Insaf’s rally passing through Islamabad, the Islamabad High Court said that it was an administrative issue and the court could not issue directives in this regard.

When Islamabad High Court Chief Justice Amir Farooq took up a petition of the PTI, the counsel for the party took the stance that the PTI has given a call for Rawalpindi rally on November 26. He said that the PTI chief Imran Khan first wanted to land his helicopter at Parade Ground before procedding to Rawalpindi. He sought court directives for the Islamabad administration to allow the party to use routes of Islamabad. The IHC CJ remarked that “your request is that I should give instructions to the administration, which I cannot. “This is an administration affair and the administration has not yet rejected your request in this regard,” the judge said.

The IHC CJ inquired what can the high court do? The high court cannot provide the helipad service.

The counsel for the PTI said that the court should instruct the administration to decide on their request according to the law. The judge replied said that they have to do it according to the law.

After arguments, the court adjourned the hearing.

Meanwhile, the Lahore High Court’s Pindi bench Wednesday adjourned till December 5 the hearing of a petition filed by a citizen against the closure of roads and shutting down of educational institutions ahead of expected PTI sit-in in Rawalpindi.
