'Attempt to harass': Makeup artist counter files legal notice against Sana Javed

Omayr Waqar's notice says Sana's defamation notice is based on 'mere presumption'.

Makeup artist Omayr Waqar has sent a legal notice to actor Sana Javed in response to the defamation notice she issued against him. He posted pictures of the notice on his Instagram handle on Monday evening.

In his counter notice, Waqar's legal team has termed the contents of Javed's notice ‘concocted’. The notice reads, "The contents of paragraph 2 are denied as concocted. It is submitted that at no point did our client name your client and has no nexus whatsoever with Manal Salem.”

The notice goes on to claim that Waqar had “nothing to do with what was said by Manal Saleem” and the fact that an allegation of innuendo has been placed on [him] suggests that [Javed] has presumed the same without any evidence or proof.”

Provided that Waqar is a “well known” and “sought after” makeup artist, “a fact which is well known to your client,” it claims, thereby, that accusing him of being part of a supposed smear campaign for publicity would be wrong. “There arises no need on the part of our client to seek publicity and accordingly, all such frivolous claims are denied as being incorrect and misconceived.”

Waqar has also categorically denied defaming Javed. "It is a well-known fact that the entire social media is brimming with stories about your client and her demeanour in general, which has nothing to do with our client and as such, this notice is nothing but a feeble attempt to harass and coerce our client from exercising his freedom of expression guaranteed to him under the Constitution of the Islamic Republic of Pakistan.”

It went on to call Sana’s defamation allegation an attempt to harass Waqar. "Our client never mentioned or stated your client’s name on any social media outlet and a mere presumption that his posts on social media were targeted towards your client are nothing but an attempt to harass our client. Needless to add, the general outbreak in respect of your client’s demeanour on social media suggests that this notice is a feeble attempt to salvage some pride.”

The notice called for Javed to withdraw her notice, and refrain from taking any further action. "Needless to add, our client shall also defend any frivolous claims brought against him by your client through witnesses and evidences well known to your client."

Earlier, Javed had sent Waqar, alongside model Manal Saleem and stylist Aneela Waqar defamation notices. In her social media post featuring these notices, Javed had called the series of allegations pouring in against her, part of a “smear campaign”.

The legal battle is a consequence of the ongoing social media battle that gripped the fashion and entertainment fraternity after model Manal Saleem shared her experience of working with “a celebrity” who demeaned her. She had initially took to her Instagram Stories to write, "Requesting all the clients to not ask me to shoot with any actress, celebrity ever again. With their self entitled attitudes, they think we are 'do takay ki [cheap] models'. The audacity to say that on my face! We also come here to work, not to be insulted for free." Her Instagram story is available in the highlights section of her Instagram account.

While Saleem too, refrained from naming the actor in question, she went on to share makeup artist Ikram Gohar’s story, in which he – upon cross sharing her statement – said, “I know she is Sana Javed, such a horrible and unprofessional actress.” Waqar, albeit, only cross shared Saleem’s post and wrote, "guess who she is talking about? PS it's just one person, not all actresses are the same.”

Following this, Gohar and Rhyan Thomas, named Javed in their posts and spoke up about their "horrible" experiences with her. Javed did not issue legal notices to them. More claims of Javed’s alleged “unprofessional” and “rude” behaviour have since surfaced. Makeup artist Wajid Khan wrote that Javed “should focus more on her acting rather than playing games with people.” While Syed Hussain, who has come forward as the MUA who was hired to style Saleem and Javed for the shoot mentioned in Saleem's original post, has corroborated the model's story.
