SC rejects expelled student’s petition seeking readmission

Apex court says state failed to fulfil its responsibilities

The Supreme Court on Monday dismissed a petition filed by a student against his expulsion from a private school.

While dismissing the petition filed by student Ryan Ahmed, seeking re-admission in a private school remarked that the state has failed to fulfil its responsibilities.

Petitioner's lawyer stated that the ninth-grade student was expelled by the school administration for abusing and misbehaving with teachers and children, but the school could not banish the child forever.

Justice Qazi Amin remarked that teachers were the best judges. The place of teachers is different in our society, educate children and not hold teachers accountable. The state has failed to fulfil its responsibilities. If the decision is in favour of the child, he will go to the school and say that the Supreme Court has barred the teachers and management from scolding him.

Chief Justice Omar Ata Bandial said that education can be obtained at home but schools were meant to maintain discipline. The judge said that parents were not happy with online classes because children were spoiling at home. A child gets ready in the morning and goes to school and he knows the code of conduct. If anyone in our class had done such a thing, he would have been punished in such a way that he would have learnt a lesson.

Justice Qazi Amin said that we are here today only because of the open punishment of our teachers.

It should be noted that the Lahore High Court had also rejected the application of the student seeking re-admission.
