Court grants bail to suspect in couple harassment incident

The Islamabad High Court (IHC) has sought answers from the Housing and Works department and Federal Government Employee Housing Authority (FGEHA) director general (DG) on the allotment of plots through balloting in sectors F-14 and F-15.

IHC Chief Justice Athar Minallah issued the order on the application of a citizen, Rao Abdul Raheem, on Thursday.

The court directed to fix the case of public interest before a larger bench and it will be heard with the case pertaining to suspension of plots for the judges of the lower judiciary.

Sardar Mohammad Ghazi, counsel for the petitioner, said that 36,000 employees, including his client, had applied for membership and paid the fee from their earnings. He added that the membership was taken to secure a plot in the future allotment, however, FGEHA made a new priority list for phase-2.

The lawyer said that the advertisement from April 5, 2015, pertaining to the launching of membership was against the approval of the premier. He pleaded with the court to give orders for the construction of plots in sectors F-14 and F-15 for employees from grades 1 to 15.

He said that according to the orders of the apex court of October 8, 2020, a grade-22 officer should be given only a single plot. The lawyer asked the court to stop the transfer of plots in phase-2 done via third party. The hearing of the case will be conducted on September 13.

Meanwhile, a district and sessions judge issued a verdict regarding the bail applications of two suspects in the couple harassment case involving Usman Mirza.

The court approved the bail of Rehan Hussain against bail bonds worth Rs1 million while it rejected the plea of Farhan Shaheen. The order said that the bail of Rehan Hussain was approved against bail bonds worth Rs1 million. It cited the police record according to which no video was filmed from his mobile phone.

The order said that Shaheen’s bail was rejected on the basis of his presence at the crime scene and he facilitated the crime. Therefore, he did not deserve bail.

Additional Sessions Judge Muhammad Sohail issued notices to the respondents on the post-arrest bail application of gardener Jan Muhammad, co-accused in the Noor Mukadam murder case.

The petitioner said that he was included in the case after investigation and rejected all allegations levelled against him. He maintained that the incident took place inside the house while the door of the suspect’s room was locked from inside.

Jan claimed that the police have exceeded their authority. He said that the allegations require further investigation and there is no point in keeping him imprisoned.

The court directed the victim’s father, Shaukat Mukadam, and the investigation officer (IO) to submit their reply and adjourned the hearing until (Friday) today. The petitioner is currently in Adiala Jail on judicial remand.
