Governor Dr Ishratul Ebad Khan has ordered the approval of the Sindh Public Property (Removal of Encroachment) Second Amendment Ordinance 2011. According to a notification, the governor did not wait for the Sindh Assembly session to start as the amendment was needed immediately.
According to the amendment act, the government may form a tribunal for each district through a notification and decide on its members as well. A tribunal shall consist of a presiding officer, who is or has been a district or an additional district judge, or has been a High Court advocate for 10 years at least.
The presiding officer, after being appointed in consultation with the high court chief justice, will hold office for two-and-a-half years. The presiding officer may be removed before his term is complete. Special courts will also be set up to resolve encroachment problems. The special court will also comprise a presiding officer who has been a sessions Judge or an additional sessions Judge, or has served the high court as an advocate for at least 10 years. The judge will be appointed for two-and-a-half years. No other court other than the special court, formed under Section 25, shall take on an offence punishable under this act unless an authorised person complains in writing for the case to be transferred.
