"It happens," joked sheriff Mike Blakely of the Limestone County Sheriff's office in Athens, New York Post reported.
The suspect, Jesse O'Neal Roberts, 23, was taken into custody on Tuesday and charged with public intoxication. He was found to be carrying a concealed weapon but did not have a permit, police said. The suspect was found to be promoting prison contraband and receiving stolen property.
"Why the owner of a stolen pistol recovered by a corrections officer might not want it back," tweeted the sheriff's office while explaining what actually happened.

Soon after Roberts crashed his truck into a ditch, he started snooping around a local resident's garage. He was eventually caught and was held at gunpoint until the police came.
Roberts' trouble did not end there as the correction officers noticed him walking strangely. Upon being searched, he stumbled accidentally and a gun, which was stolen, allegedly "fell out of his butt."
"I immediately considered that he defecated on himself before noticing a familiar shape in the form of a pistol in his boxers," the report quoted one of the corrections officers as saying.
Fortunate enough for Roberts, the gun, Jimenez 380, was not found to be loaded. The man was apparently a Crimson Tide fan since 2014, as depicted in one of his Facebook statuses. Roberts was held for $7,250 bond on Tuesday.
