Calling on the Commandant: Families of slain khasadars yet to be compensated

Court extends stay order on arrest of AWKUM VC Dr Ihsan Ali

A division bench of the Peshawar High Court has sought replies from the Frontier Constabulary commandant and Mohmand Agency political agent for not paying compensation to the heirs of slain khasadar personnel under the Shuhada package.


On Wednesday, PHC Chief Justice Mazhar Alam Miankhel and Justice Waqar Ahmad Seth were hearing applications filed by the heirs of Umer Khan, one of the deceased khasadar personnel.

Arguing before the bench, lawyer Imtiaz Ahmad Yousafzai said Umer, petitioner Naeem’s father, was martyred on September 5, 2009 while fighting terrorists.



He said the government only paid Rs0.3 million under the Shuhada Package when the solider should have been provided Rs3 million.  Yousafzai said even the political agent’s office, through a notification to the FATA Secretariat, asked for the full compensation payment for the victim’s family. Mujahida Bibi’s husband also lost his life in the line of duty and his legal heirs had not been paid compensation under the package.

The bench, after hearing the arguments, issued notices to the Mohmand Agency political agent and FC Commandant, seeking their replies.

Stay extended

The same bench extended a stay order restraining the National Accountability Bureau from arresting Abdul Wali Khan University Mardan Vice Chancellor Dr Ihsan Ali. The justices were told the petitioner’s lawyer, Qazi Muhammad Anwar, was at the Supreme Court of Pakistan and would not be able to appear before the court. The bench extended the stay order, restraining NAB from arresting Ali.

The VC has been charged with illegally recruiting people in violation of merit and NAB initiated an enquiry against him. To avoid arrest, the VC went to the PHC and got a stay order on December 10, 2015. However, the court has directed him to cooperate with NAB.
