Massive reduction: Litigant to submit security worth Rs12m

PESHAWAR: The Peshawar High Court set aside a civil court order which asked a man to submit surety bonds worth Rs86 million. It told the applicant to submit bonds worth Rs12 million instead. A division bench comprising justices Nisar Hussain and Younis Taheem was hearing a writ filed by Arshad Pervez through his lawyer Khalid Anwar. The counsel said his client started a medicine business with Hammad Malik in a partnership. Anwar argued that Pervez returned Rs53m with interest to the partner, but differences emerged during their dealings. He added his client moved a civil court which directed him to submit surety bonds worth Rs86m before the start of a trial. He stated the trial was yet to begin. On the other hand, Malik’s lawyer argued the writ was not maintainable as the civil court had issued interim relief.
