PHC Chief Justice Mazhar Alam Miankhel was told Khog Amin’s vehicle was stolen in 2009 from Khyber Bazaar and an FIR was registered at Khan Raziq police station.
His lawyer Jamroz Khan argued the police at a check point near Darra Adam Khel recovered his vehicle. “Amin filed an application at a local court but the prosecution witness did not appear in court,” Jamroz said.
He added another application was filed in the court of an additional sessions judge, but it was dismissed.
Additional Advocate General Syed Qaiser Ali Shah said the court registration papers of the vehicle were not fake and police are investigating the matter.
The chief justice asked why the investigation was not completed. In reply, he was told prosecution witnesses refused to appear before the court despite court orders. This eventually led to delays in deciding the cases. The court issued notices to Shafeerullah and Khalil. They are required to appear before the court on December 14.
