A division bench of the Sindh High Court restrained authorities from implementing the impugned order and issued a notice to the respondents for a date to be fixed later by the office of the court.
Dr Badruddin Shaikh, the deputy director of the National Programme for Improvement of Watercourses, moved the court maintaining that a flat in an official complex at Clifton that is meant for Secretariat group officers was allotted to him on April 21, 2010, but on October 19 last year, the premises was allotted to Shazia Wahab, a medical officer of rank BPS 17.
The medical officer is a junior and is not part of the Secretariat group and thus the allotment of the flat to her is illegal, submitted Barrister Zamir Ghumro, the petitioner’s counsel during Friday’s hearing.
The bench, headed by Chief Justice Sarmad Jalal Osmany, while ordering the issuance of pre-admission notices to respondents restrained them from implementing the impugned order of allotment to the medical officer till further orders.
