Treason case: Musharraf's lawyer presents notification of 2007 emergency before Special Court

Farogh Nasim says notification includes names of people who were consulted regarding the emergency.

ISLAMABAD: To prove that former president Pervez Musharraf did not act alone when he imposed emergency in 2007, his recently-appointed lawyer Farogh Nasim presented the notification issued for the declaration before the Special Court, Express News reported on Tuesday. 

Nasim presented the notification during a hearing of the high treason case against Musharraf, which was heard by a three-member bench headed by Justice Faisal Arab. The hearing was postponed till tomorrow.

On March 31, Musharraf was formally charged for subverting and circumventing the Constitution by imposing emergency on November 3, 2007. Musharraf had rejected the charges levelled against him.

During the hearing today, Nasim stated that the names of the people who were consulted regarding the imposition of the emergency in 2007 were included in the order.

Nasim argued that according to the law, all those involved in the alleged crime should be tried together to which Justice Arab replied that the Special Court does not have the authority to hear other cases.

Musharraf's lawyer further added that it was now the responsibility of the prosecution to prove that these people were not consulted and the former president acted alone.

Prosecutor

Furthermore, with regards to the request concerning the appointment of prosecutor Akram Sheikh, the Special Court will announce its decision on April 18. It had reserved its decision on March 26.

Musharraf’s ex-lawyer Anwar Mansoor had said that the notification of the prosecutor was issued by the Law Ministry in violation of legal norms, further alleging that the prosecutor himself was biased.

@Adnan Siddiqi: I fully with you, but in the same breath will you explain how SC in Islamabad with more than 60 judges was stormed by the supporters of PML N during last stint of PMLN govt in the 90s..? case is still pending with the SC but till today nothing has been heard on this important issue....and all seem to have forgotten....what a memory we have,!
