Transparency required: Lawyers demand legal experience, NTS exam as criteria for judgeship

PESHAWAR: Lawyers demanded the Peshawar High Court (PHC) chief justice (CJ) make three years experience and the National Testing Service exam mandatory for the appointment of new civil judges in Khyber-Pakhtunkhwa (K-P).

The K-P Bar Council, and District Bar and PHC Bar associations boycotted court proceedings on Monday and held a meeting to strategise on the appointment of 77 civil judges.

Advertisements for the posts were earlier published in various newspapers.



K-P Bar Council Executive Committee Chairman Advocate Arshad Awan shared the lawyers’ demands with the media after the meeting. These include three years experience as a practicing lawyer, NTS exam, adequate representation of lawyers in the selection board, and the abolition of the quota system.

“The lawyers have rendered countless sacrifices for the independence of the judiciary. We want new judges appointed at the PHC who have experience so litigants get the justice they deserve,” said Awan.

Sindh and Punjab had two years experience as one of the conditions for the appointment of civil judges, added the chairman. “We will sit with the judiciary to find a suitable way to solve the problem.”

The lawyers will discuss all their demands with CJ Dost Muhammad Khan and raise legal points, stated K-P Bar Council Vice Chairman Amjid Shah.  “Corrupt judges bring a bad name to the judiciary and we want the appointment of new judges with full transparency.”

A few days earlier CJ Khan held a meeting with representatives of lawyers and assured them new judges will be appointed through an NTS exam. Lawyers had welcomed this decision.

The PHC advertised posts for 77 civil judges, judicial magistrates and illaqa qazis, and sought applicants with the domicile of Khyber-Pakhtunkhwa and the Federally Administrated Tribal Areas (Fata). The 77 posts are divided as follows: 17 to merit, 10 to Zone-I, 10 to Zone-II, 11 to Zone-III, 10 to Zone-IV, 10 to Zone-V, seven for women, one for people with disabilities and one for non-Muslims. The posts are Basic Pay Scale-18 and the age limit has been set between 23-28 years.

This year the daugher of CJP, Peshawar high court Dost Muhammad Khan daughter will be sitting in the said test, Some people are saying that he delayed this test for an year, as the daughter of CJP was in her final year of LLB...
