Gang-rape victim alleges that Jamshed Dasti threatened her to withdraw case

Pakistan Peoples Party (PPP) legislator Jamshed Dasti has allegedly threatened gang-rape victim Mukhtar Mai to withdraw her appeal in the Supreme Court against the accused rapists.

In an exclusive interview with The Express Tribune, Mukhtar Mai, an iconic character who came to the limelight for her brave fight for justice after being gang-raped, has alleged that MNA Jamshed Dasti is threatening her family through his emissaries to withdraw the case or face dire consequences.

In 2002, Mukhtar Mai, a woman from a remote district of Southern Punjab Muzaffargarh, was allegedly gang-raped by order of her tribal council as punishment for her younger brother’s alleged relationship with a woman from a powerful clan. Instead of living in shame, as is the case with most victims in Pakistan, Mukhtar set a valiant precedent by pursuing justice and knocking on the door of the court.

“Mr Dasti threatened me last week through his messengers in Mir Wala (Muzaffargarh) to withdraw my case from the apex court and to compromise with the Mastoi Brathery, 14 members of whom are in prison,” Mukhtar Mai said in an exclusive interview with The Express Tribune.

Mukhtar also alleged that Dasti, through the supporters of Federal Minister for Defence Production, Sardar Qayyum Jatoi, whose constituency she lives in, is putting pressure on her family in all sorts of ways.  She said that her 60-year-old father, who is a woodcutter by profession, had also been warned that he would have to face the music.

In a message to her brother Hazoor Bakhash, Jatoi’s supporters had been pressing the family to ask DPO Muzaffargarh to remove the police check post from outside their house, she said, adding that her family was in immense fear and did not know how they would survive in Mir Wala if this sort of pressure is kept up.

She said that she had visited Aitzaz Ahsan, her lawyer, in Lahore and briefed him on the situation last week, requesting him to ask the authorities concerned to ensure the safety of her and her family. Aitzaz, who she said has not charged a single penny for the case, asked her to keep resolute; the case, he ensured, will soon be taken up by the Supreme Court and justice will be delivered, said Mukhtar.

Meanwhile, when approached by The Express Tribune, an unabashed Jamshed Dasti, who is no stranger to controversy, confirmed that he had indeed requested Mukhtar to reach a compromise on the matter.

He claimed that the judgment delivered by the then Anti-Terrorism Court in the case was adversely affected by immense pressure from then president Pervez Musharraf and anti-Islamic lobbies. “I swear, the persons imprisoned in jail are innocent and the court has no justification giving the death sentence to the accused persons in a gang-rape case,” a furious Dasti said. The Supreme Court may take up the case and decide it within ninety days, he said, criticising Mukhtar as someone who distorted the image of Islam and played into the hands of non-Muslim NGOs.

When asked about Dasti’s unreserved comments, Justice (Retd) Tariq Mehmood told The Express Tribune that the statements amount to ridiculing and defaming the court, which has announced a proper judgment after conducting proper proceedings.

Also pointing out that the matter is subjudice, Mehmood questioned how anyone can comment on the case. Mr Dasti’s comment on an under trial case, he said, primafacia amounts to contempt of court; he could be summoned by the apex court, he added.

Only affected persons can file an appeal to seek justice from the court, he concluded.

    Threatening victims(or attempting to do so)into submission is not uncommon in any country/culture, but perhaps more so in ours because we’re unable to provide hope to victims for justice in the first place. What is truly commendable is the media role in highlighting injustice and hence providing victims some hope for redress, plus providing deterrence for future violations. Recommend

    Here are two things that Aitzaz Ahsan should do immediately.

    It is a crime to threaten and intimidate witnesses in a criminal case. Make sure that criminal charges are brought against Mr Dasti and his chamchas. It is amazing that Tribune, the supreme court and her own lawyer are not paying attention to this crime.
    He is not just her lawyer, he is also a member of the odious PPP. He should condemn Mr Dasti in public and demand that his party punish this criminal behavior. Failing that he should either resign from the PPP or resign as Ms Mai’s lawyer.

    And here is something the rest of us can do: Acknowledge our role in letting Ms Mai down. She made a supreme sacrifice for us. We made none in return. Instead of whining about politicians, we should be camping outside her house and greeting any of Mr Dasti’s champchas that come around.Recommend

    Dashti’s antics reflect General Musharraf’s comments in NY at the start of the Mukhtar Mai case. Both sides of the coin are the same – the majority of men in power in this country think alike – mostly like feudals.

    One wouldnt be surprised if Mai’s father was beaten up or killed by “unknown assailaints” or if she herself was bumped off or disappeared. The poor and the weaker sex are increasingly becoming vulnerable and marginalised, and not everyone can turn to lawyers like Aitizaz Ahsan for legal aid, moral support and protection.Recommend

    For generations women like Mukhtaran Mai have had to face and fight their rapist and in fear of death and harm to themselves and their family.
    Pakistan Peoples Party (PPP) legislator Jamshed Dasti should be booted out of office, but alas Pakistani men and you know who you are are a bunch of shameless people who will not oust Hamshed Dasti.
    Pakistani men are dishonoured who will write heavily worded blogs, and pretend to be outraged but in reality will put their tails behind & run.
    There has been very superficial rage to the rape and mistreatment of women in Pakistan because no matter what one says; They are considered as second class citizens and till that changes, women will be raped, assaulted and abused & we will suffer in pain.Recommend

    Unfortunately, the dishonorable PM gillani has repeatedly stated that he will protect dast(i) and will not allow him to go to jail. Infact, gillani, the defender of all louts, has even stated that he is prepared to fight the courts over mr Dast(i), a person he really admires.

    Given the above, there is little chance aitzaz ahsan, god bless him, or the courts can do anything.

    If instruments of courts are making a mockery of courts by indulging their selves in politics and giving statements to expressly declare their tilt towards a particular party, then why this loose cannon Dasti should be an exception. This is a unique phenomenon in the 63 long years of this country that an opposition party is playing the role of government, media is playing the role of judiciary, and judiciary is playing the role of politicians.

    Can somebody ask Mr. Tariq Mehmood, who took oath on PCO like his source of admiration (his Excellency Mr. Iftikhar Ch.) that is there any penalty for the wrong doings of Judges, or they are above all the codes both moral and professional? Last night I heard him saying that if Kh. Sharif has said something in innocence then he should not do it again. What an idea, first you murder justice through the judicial powers you have and then claim your innocence and continue working as an instrument of an important constitutional institution such as Judiciary!

    Lastly let me ask the champions of justice in media, is this justice that you highlight the wrong doing of a particular party and cover-up the others’? What a shame!Recommend

    You are great dear Dasti to stand up for truth and justice. I had written much against you for that fake degree and feel ashamed now. I had wondered why people supported you despite that media toofan against you and how could you defeat Nawabzada and Mustafa Khar in the election. Now I understand you.

    As regards MM, I may clarify that I have no personal grudge against her. What I hate is the shameful fraud case she launched against the poor Mastoies. On the other hand I admired CJ of SC, Iftikhar Choudhary, for his valiant stand against the firouniat of Mubashir, but he disappointed me for his meddling in this case which resulted in incarceration of Mastoies for over 5 years despite they having been acquitted by the High Court. God knows how long he takes in deciding the appeal of poor Mastoies. Recommend

    It is fantastic to read the support all of the authors of these letters have given to Mukhtar Mai. I just read her story recently and I am truly inspired by her courage, humility and resilience. I am also aware of the rhetoric that Parliamentarians have used to kidnap and place her under house arrest. They say that she makes a mockery of Islam and the Pakistan Government in the west, when in fact it is they that do this to themselves through their threats and incompetency. To read this latest instalment of her being threatened again by this PPP legislator just makes the situation worse- he should be thrown in jail like any other common criminal.

    In her book, Mukhtar Mai praises her Imam for his support in the initial period following her rape, and expresses her devotion to Allah. There is NOT ONE word from her mouth that is negative towards Allah. What is evident, however is that the name of Islam and Allah was initially MISUSED to justify Mukhtar Mai’s rape, and it continues to be misused to justify corrupt and evil men trying to intimidate and harass innocent men and women.

    As it is men that hold most of the power in Pakistan, it is up to the religious leaders to not only take a stand against men who rape women, but also men who blaspheme the name of Allah in trying to justify their evil actions. If good men allow these crimes to go unpunished, then through their inaction, they also allow the name of Allah to be slurred.Recommend

    Which court, in the view of Tariq Mehmood, had announced a proper judgment after conducting proper proceedings – the trial court or the High Court?
    For his information, the trial court had sentenced 6 of the accused Mastoies to death whereas the LHC reversed this judgment by quashing the death sentence with a strong stricture against the trial court for sentencing the accused to death without any evidence.
    But before the acquitted persons could be released the CJ of SC intervened with his suo motu just as Musharraf had used his martial law against CJ to take up the case himself. He suspended the judgment of the LHC, sent all Mastoies to jail and let the case lie in limbo for over 5 years. I wonder if it is still there with the accused languishing in jail without any judgment announced and without conducting any proceedings just by suo motu power. Recommend
