IHC seeks stay over military court execution ruling

ISLAMABAD: Islamabad High Court on Thursday issued notices to the interior ministry on a plea seeking records on the whereabouts of an allegedly missing person who has been sentenced to death by a military court over his involvement in the Bannu jail break.

Justice Noorul Haq Qureshi asked the ministry to submit a reply within a week. Meanwhile, the court rejected an oral submission seeking stay of execution.

Mir Shah Khan, a resident of Bannu, approached the court claiming that his son, Tahir, was abducted by some unidentified men on February 24, 2014.

On September 3, the petitioner heard that Tahir had been sentenced to death by a military court for his involvement in the Bannu jail break.

Khan cites interior secretary and state as respondents.

In the petition, Awan stated that the family members reported the incident to the Station House Officer (SHO) of Raiwand Police Station in Lahore for tracing the missing person but the police kept prolonging the investigation process and made a mockery of the indigent and illiterate people.

Awan stated that under no law or circumstances a father can be denied of meeting his son and that too if the son is a death-row prisoner. He said it was the legal right of every person’s heirs to be made aware of the charges levelled against the suspect so that they can defend their case.

He prayed the court to direct the interior ministry to produce the whereabouts of petitioner’s son and facilitate a meeting with him for the purpose of seeking instructions and filing proper appeal against the judgment, if any passed, by the military court.

He further prayed that the respondents may also be directed to produce documents related to the case of the petitioner.

The court while issuing notice to interior ministry adjourned the case for next week.
