Builder takes Cantt board to court

Petitioner questions demand of Rs259 million to pay ‘several charges’ that the cantonment board had made.

KARACHI: A builder has taken the Faisal Cantonment Board to court over its demand to pay Rs259 million for a project.

On Thursday, the Sindh High Court (SHC) division bench was hearing a constitutional petition filed by Kay Kay Builders. The petitioner, through one of the directors of the company, questioned a demand of Rs259 million to pay ‘several charges’ that the cantonment board had made.

The petitioner explained that the company had submitted a revised site plan for a project on October 19, 2009. The board had not contacted them or responded to the plan for around nine months and then, on June 10, 2010, it had conveyed 16 objections. The builders removed all objections in the plan but then, in a letter dated July 7, 2010, the board again sent a letter to the company, asking for Rs259 million. The petitioner said this time they asked why so much money was needed. However, the respondent ignored the inquiry so they got in touch with the regional headquarters of the board. But the headquarters also refused to take any action.

The petitioner prayed the court to direct the respondents to prove that the demand they had made was legal or to declare the demand illegal and restrain the board from forcing them to pay up.

The bench, after hearing the counsel for the petitioner, issued pre-admission notice to the respondent cantonment board for a date to be fixed later by the office of the court.
