Novelist Kapil Isapuri filed a plea in the court accusing the Rajkumar Hirani-directorial of plagiarism.
The movie, which raises questions about religion and people's blind faith in god men, has been co-produced by Vidhu Vinod Chopra and Hirani. It also stars Anushka Sharma and Sanjay Dutt.
Justice Najmi Waziri issued a notice to Hirani, Chopra and scriptwriter Abhijat Joshi in this regard seeking their response by April 16.
Isapuri has alleged that certain portions from his Hindi novel Farishta, published in 2013, were "stolen and copied" and used in the film. He has sought punitive damages of Rs10 million from the filmmakers along with credit for his work.
The plea, filed through advocate Jyotika Kalra, alleged that the makers of the film as well as scriptwriter Abhijat Joshi stole the characters, expression of ideas and sequences from the novel "Farishta".
"The novel has criticised blind following of so-called god men and that profession of religion is not natural but is man-made and artificial and, in a group of people, nobody can identify their respective religion," the plea said.
"The plaintiff (Isapuri) watched the film and realised that the scenes (sequences) and expression of ideas in the film have been stolen from the novel of the plaintiff. Plaintiff is the creator and original author who created and identified the subject of religious and cultural hypocrisy in modern era and expressed," the plea added.
Stating that copyright subsists in the work of Isapuri and no other person has any right to publish the same without his permission, the plea sought permanent injunction on telecasting or broadcasting the film to the public.
The court recently dismissed a plea which sought a ban on the film for alleged derogatory remarks against Hindu gods, Hindu beliefs, faith and worship.

@Razi: Lol! The "Butcher of Gujarat" as you call him, looks like an angel compared to your own prime minister. Thousands of minorities have been slaughtered in Pakistan under Nawaz Sharifs watch compared to 700 Muslims and 300 hindus killed by police firing in Gujarat. in a riot instigated by Muslims. But then Pakistanis will look at Gujarat/Palestine/Burma/Sri lanka/tumbuktoo or elsewhere but never at their own sorry state of affairs
I doubt Isapuri's claim will hold up in court......this looks like a low level ' shake down '.

The Butcher of Gujarat, whom you guys made your Prime Minister, also happen to belong to a certain religion whose adherents didn't try "to kill Hirani or Amir Khan". Once there was a lunatic fringe in India; now it's the lunatic mainstream.
Being a Hindu, I loved your movie Mr Hirani and also I am proud that no one has tried to kill you or Amir Khan. But please dont try this with other 'peaceful' religions, you are too precious for us Indians.
