The PTI had initially submitted the petition on September 2, requesting the disqualification of PM Nawaz for allegedly making false statements on the floor of the National Assembly regarding the role of army in the country’s continuing political crisis.
The petition argued that the PM had asked the army chief General Raheel Sharif to act as a “mediator” between the government, PTI and Pakistan Awami Tehreek, and serve as a “guarantor” to any agreement between the parties concerned, which he later denied on the floor of the house.
According to the Article 62 (f) of the Constitution a person is not qualified to be elected or chosen as a member of Parliament unless he is “sagacious, righteous, non-profligate, honest and ameen”.
PTI argued that since Nawaz had given a 'false' statement, he should be disqualified as a member of the NA.
When the petition was first filed, the Supreme Court's registrar office raised objections against the petition and refused to admit it. However, these have now been set aside, and the hearing has been scheduled for early next week.Earlier, the registrar office had rejected PTI leader's plea by raising objections.

@S.R.H. Hashmi: Agree with you 100%. There are ample proofs of Nawaz Sharif lying, cheating, stealing money. He and his brother lied about ending loadshedding in six months when they knew fully well that is impossible, they lied about bringing bullet train to Pakistan when they fully knew Pakistan does not have that kind of money (even America has determined it cannot afford a bullet train), and they lied about bringing Zardari to justice and intead have become partners with him. All of his lies should be put in front of the court and then the shame will be on the courts if they still do not declare him unfit to be prime minister.

IK announced in around 17 August 2014 that he and his followers will go for civil disobedience and he subsequently burnt the electric bills he received. He vowed and asked his followers not to pay electric bills and govt. taxes. The latest is that without announcing his withdrawal from his commitments, he has paid the electric bills for his Lahore residences and other facilities with late payment surcharges, which amount to a total of one lakh rupees and could go over if the bill for Bani Gala is included. The point is did he lie? He said one thing but did the other. Now, do his followers need any further proof of his infidelity and can't they see he is untrustworthy. For those who are blinded by his charisma, this evidence would mean nothing. Further, he talks about ending VIP culture then look at the amount of electricity he consumes. Look at the bills, which do not include the electricity consumed at Bani Gala. If he is really with the people, as he claims, he should sleep under the open skies with his sit-in followers and not in his sheltered container and not in Bani Gala anyway. The upshot is before accusing others of lying, he should stop lying himself.

It is nice to learn that after setting aside objections initially raised by its Registrar's office, the Supreme Court has admitted the petition by Pakistan Tehreek-e-Insaf leader Ishaq Khakwani, seeking disqualification of Prime Minister Nawaz Sharif under Article 62(f) of the Constitution, which restricts Parliament membership to those who are 'sagacious, non-profligate, honest and ameen' and the hearing is expected early next week. While on the topic, I vaguely remember when Nawaz Sharif returned to Pakistan from Saudi Arabia before the agreed period of ten years, and he was reminded of the terms of the agreement, he kept on insisting that there was no agreement and demanded it to be shown if there was one. And then the Saudi Prince came and flashed the agreement after which Nawaz Sharif said that the understanding was for five years.
And there would have been other grounds for holding him ineligible for membership of the Parliament, like loan default,etc but unfortunately the Returning Officers failed to scrutinize the cases of assembly aspirants' thoroughly to ensure that they met the conditions as laid down in the constitution.
I think Prime Minister's immunity will not be invoked in this case because in my opinion that would have come into play only in case of a lawfully appointed Prime Minister and not the one who failed to meet the eligibility criteria and should not have been allowed to become an assembly member in the first place, much less a prime minister.
I hope the superior judiciary will not disappoint the nation and will act firmly and forthrightly as against the Returning Officers who utterly failed to discharge their duty. This is a do or die moment for Pakistan. Luckily for us, Dr. Tahirul Qadri, Imran Khan and their devoted followers have stood up and have suffered great hardship so that we all, and the coming generations may have a better future. It would be a shame to see that all go to waste simply because those who were in a position to bring all this to fruition failed to take resolute action.

You said nothing when the courts disqualified Gillani. They won't dissolve the assembly but disqualify the PM who has violating the constitution by lying under oath.

This is highly alarming, and seems like a backdoor to shoving out Pakistan's democratic government after the dharna farce appears to be fizzling out. The more things change, the more they stay the same in our country, unfortunately.
