ISLAMABAD: A case was registered in the Islamabad High Court (IHC) against former president Pervez Musharraf for the murder of Abdul Rashid and his mother during the Lal Masjid operation, Express News reported on Monday.

Earlier, the IHC stopped Station House Officer (SHO) Aabpara Police Station, Qasim Niazi from leaving the courtroom, saying that he would not be allowed to leave until a case was registered against Musharraf.

After the case was registered, he left the courtroom.

IHC Justice Noorul Haq Qureshi said that not registering a case despite the court’s orders falls under contempt of court.

On Friday the IHC summoned the SHO over non-compliance with the court’s orders to look into whether a case can be registered. The IHC Justice directed the SHO to appear before the court on September 2 in response to a contempt application filed by Haroonur Rashid Ghazi — the son of slain Lal Masjid cleric Abdul Rasheed Ghazi — against the police for non-compliance with court orders and sought criminal proceedings against the police official.

On July 12, 2013, the same bench had ordered the police to book the former president, and if the Lal Masjid operation was a cognisable offence, a case be registered against Musharraf for the death of Ghazi and others during the operation. However, the police had refused to register an FIR, saying that it would do so after consulting their legal branch.

Tariq Asad, the counsel for the petitioner, had said that they approached the concerned police station after the court’s decision but both the SHO and SSP refused to register the case.  Earlier, Haroon had filed a written statement with the Aabpara police in which he said the former president had made threatening statements on two occasions before the military operation on the mosque was launched in July 2007.

    This is a very irresponsible behavior on part of Express Tribune. Why aren’t they highlighting the fact that hundreds of innocent students were killed in the siege on the orders of the notorious ex dictator of Pakistan.

    It means our brave soldiers who laid down their lives to restore writ of the State are also murderers. What about those who are killing terrorists in Swat, FATA and Baluchistan. Are they murderers too? We have seen this day because our courts are afraid of terrorists and generals have become property dealers.

    Query – how long does one allow religious extremist to take over a city before your allowed to forcefully remove them? How many times are you required to ask them to cease and desist? Why are religious extremist allowed to walk free by every court in the land?

    I greatly respect your even handed and principled comment on this issue. As a strong supporter of Mian Saab you probably do not have much love lost for Musharraf. Yet when he is being punished for something wrong, you have spoken up. Salute.Recommend

    Salim Shahzad, the noted journalist, in his book which came out after he was brutally murdered said approximately “Lal Masjid is an Al Qeada cell”.

    Judicial commission report (comprising of justice Javed iqbal) on Lal Masjid has clearly told the figures.. 102 persons killed,, 89 those who were present inside the mosque and 13 soldiers…
    Now its upto your good sense to understand that who killed 13 soldiers,,,,
