Interestingly, at the time of signing of the instrument of accession, the then Indian Governor General, Mountbatten, had remarked: “It is my government’s wish that as soon as law and order has been restored and her soil is cleared of the invader, the question of the state’s accession should be settled by a reference to the people.” His remark and the offer made by the Indian government to conduct a plebiscite or referendum to determine Kashmir’s future status had made it into more of an Indian problem than ours. Maharaja Hari Singh, while signing the instrument of accession, had actually palmed off, to India, ‘Azad Kashmir’ — not a state willingly joining the Indian Union. By 1952, Sheikh Abdullah had become totally disillusioned with the Indian government’s consistent failure to fulfil its promise of according special status to Kashmir. He began insisting on self-determination. His government was dismissed and he was arrested in August 1953, after which New Delhi tried to push the Kashmir problem under the carpet forever, by getting a puppet assembly, led by Bakhshi Ghulam Muhammad, to ratify the instrument of accession, in 1954.
There was no way India could have resolved the ‘Azad Kashmir’ problem with brute force. The 1960s, 70s and even 80s were the decades of freedom movements. World opinion was with freedom-seeking subjugated nationalities and sub-nationalities. Patience was required on our part. But that was what we lacked then and lack now. We immediately turned Kashmir into an Indo-Pakistan problem by sending in army-led lashkars into Kashmir, on October 22, 1947. These were Cold War days. We had chosen the American camp and India, the Soviet one. So, not surprisingly, we lost our Kashmir case to superpower rivalries. By the way, Gilgit-Baltistan was not liberated by these unruly lashkars. This region won its freedom, at about the time of Partition, as a result of a heroic struggle launched by officers in the Hari Singh Army, stationed in the Northern Areas. We aggravated the situation in Indian-held Kashmir by sending in infiltrators, in 1965, which led to a full-fledged India-Pakistan war, which, in turn, made it almost impossible for the Kashmiri freedom fighters to make the world believe that what was happening inside Indian-held Kashmir was not a Pakistan-sponsored separatist movement. In the process, we turned a purely Indian problem into a bilateral one, forcing the world to choose sides. Then, in the 1990s, we further aggravated the issue by sending into IHK, well-trained, well-armed jihadis. In retaliation, India increased its troop strength in the valley. An indigenous, peaceful Kashmiri intifada had turned into a bloody battle, with innocent Kashmiris caught in the crossfire, dying by the hundreds. The icing on the cake was Kargil. This was when our regular troops were caught red-handed impersonating the so-called Kashmiri freedom fighters with the world looking on. If we could get out of the equation, even at this late hour, perhaps India would soon realise the impossibility of keeping a people under perpetual bondage.

Jammu and Kashmir was not a princely realm until 1846, when the British sold Kashmir to Gulab Singh for 75 million rupees, without consulting the Muslim population. During Partition, an indigenous revolution began in Kashmir when his son Hari Singh refused to sign with Pakistan.
When it was clear that he had no respect for the aspirations of the Muslims of Kashmir, Jihad was declared which led to the support by Afghani and Pakistani Muslims for Kashmiris. The British army officers under the control of Pakistan refused to fight in that war, even though India's British officers and army invaded Kashmir and forced Hari Singh to sign Kashmir to India under duress.
@Anonymous: So why then did India invade Junagadh and Hyderabad? Those were Muslim rulers signing to Pakistan who controlled territories with a majority Hindu population. Even though Hyderabad city was always Muslim majority until very recently, India invaded and dispossessed the Nizam of Hyderabad.
The fact is the British and Hindus conspired against Pakistan and Muslims from day one. The Punjabi Muslim majority district Ferozepur was given to India, and subsequently cleansed of Muslims by genocide.

While reading your comments on this page for the last few days, I felt an urge to share a few facts with you that are essential to understand the legal aspect of Kashmir's accession with Pakistan, or with India, or it's independence. Read carefully. . Muslim majority districts awarded to Pakistan & the rest (Hindu/Sikh majority being implied) remaining with India was applicable only for British territory. That principle did not apply to the areas controlled by the Princes ( like Hari Singh of Kashmir) who had the freedom to go independent or join India or Pakistan as per their (not necessarily per people’s) choice. In such places the Maharajah or Nawab or Nizam as the case may be mattered. Radcliff was not authorised to divide Princely India. It was not a simple matter as Secular v/s Islamic or even little more complicated plebiscite. It was a matter of Brtish Act of Parliament & agreements between Crown & Princes. If Pakistan or any other country wishes to help us get our rights, we Kashmiris welcome them. Only Pakistan can secure our rights against a hungry occupier like India. Kashmir is a part of Pakistan. We were denied our right as a Muslim majority population to join with our brothers in 1947. This is our inevitable destiny, whether India may like it or not.

No matter whose "problem" KASHMIR is , I notice that no one has raised the point that during the so-called militancy, thousands of Kashmiri Pundit families were compelled to abandon their homes, home-land and professions .

Also I never referred to Ranjit Singh as a Maharaja, just like I never refer to Gulab Singh of Kashmir as a Maharaja. These are not kings, but usurpers who bought, sold, and exterminated lives of human beings who belong to Allah Almighty alone. Please don't make irresponsible, off-the-cuff remarks without any basis. Maharaja's administration was active throughout his realm, including territories right up to Abbottabad as also Gilgit-Baltistan. Those were the days when sovereigns were jealous of their control of their territories and would not countenance "limited control". You couldn't step your foot over the boundaries without being quizzed. It was Sheikh Abdullah's lack of confidence in his acceptance by people in territories beyond the LOC that cease fire line (CFL) was established on that line. His friendship with Nehru made sure that the Indian army could not chase the raiders clear out of the state in spite of its desperate entreaties to Nehru to allow it to do so.

If we don't then we are wrong but if Pakistanis are so pained about the Kashmir issue just acknowledge pok sovereignty and declare northern areas and so called azad Kashmir as a free country and put us in the back foot. If Kashmir is an integral part of India because, as you say, it used to be Hindu land, then the whole of India is an integral part of Pakistan as it was part of the Indus Valley Civilization which started in areas now in Pakistan even before the Hindu mythology was concocted.

Even if all of that was done, India still wouldn't hold a referendum in Kashmir because they know that the outcome is going to be against them, India hasn't even let Human Rights Watch or Amnesty International into Jammu and Kashmir, if they haven't done anything wrong, then what are they hiding?
India couldn't even give the people of Khalistan the right to self-determination, so I wouldn't expect them to give Kashmris that right.

Maharaja Hari Singh signed the instrument of accession with the government of India, on October 27, 1947, ignoring the principles of geographical contiguity, ethnic compatibility and the faith of an overwhelming majority of the population. . Geographical continuity did not dissuade Pakistan from having two wings separated by thousands of kilometers of land. . Ethnic compatibility, there is nothing similar between Punjabis, Sindhis, Pashtuns, etc. and Bengalis. . Now to the poignant aspect, faith. However India never gave credence to the Two Nation Theory and never called itself a Hindu nation and moreover India even back in 1947 had millions of Muslims who never went to Pakistan. . He was actually seeking Indian military protection against his own subjects who had risen in revolt against his oppressive rule. . No, this is not true at all. Hari Singh knew that the Pakistani regulars and irregulars were just a day away from Srinagar when he signed the Instrument of Accession. Unbeknownst to him, the irregulars were enjoying their plunder and did not enter Poonch Valley until later. . Maharaja Hari Singh, while signing the instrument of accession, had actually palmed off, to India, ‘Azad Kashmir’ — not a state willingly joining the Indian Union. . Not true at all. What you call Azad Kashmir and Gigit Baltistan belonged to the Maharaja by succession even though he had limited control during his lifetime over those areas. . India invaded Indian Occupied Kashmir first. The Indian invasion of IOK started much earlier than the Pathan intrusion and Pakistan Army’s involvement. It was all started by and planned in meetings between rulers of Alwar, Kapurthala and Patiala with Maharaja of Kashmir, the first one was held in Mar 1947 resulting in what was popularly known as the Sikh Plan, with complete knowledge of Indian Hindu political leaders and their supporters in Indian government.
Many of us do not even know that after the pogrom in Punjab where Muslims were killed in millions in order to ethnically cleanse the areas and change the demography, where did these marauding Hindu and Sikh hordes were sent to? Indians wouldn’t know or probably wouldn’t want to acknowledge it – these hordes were sent to Jammu to loot, rape, abduct and kill Muslims.
As planned, in the initial instance, they intended to ethnically cleanse areas of Jammu where Muslims were in minority. Between July and October 47, over 500,000 Muslims were thrown out of their homes, out of which over 250,000 thousand men, women and children were killed and about 300,000 were forced to emigrate to Pakistan. This was the first stage of this operation. When news of this massacre reached the Frontier Province, the Pathans came to safeguard the Muslims from hordes of marauding Sikhs and fundamentalist Hindus and Pakistan Army moved in later when Indian Army had already invaded IOK.
This is a fact and is well referenced in history.

Whatever justification Pakistan has to give itself to stay out of Kashmir I don't really have a problem. The point is it should stay out.
With all the History lesson and praise for Shiekh Abdullah, the author has forgotten to mention couple of facts:
1) Nehru and Abdullah were very close. 2) Abdullah even changed the name of his party from Muslim Conference to National Conference at the insistence of our first PM.
Admitting he had popular support but ignoring his assent to the accession is duplicitous. But, I do understand, if you state the above the 2 facts, you would actually not serving the purpose of this article which is to convince Pakistanis to stay out Kashmir. And, in your "noble" act, you have our support, at least mine.
But, if anyone thinks things will get worse for India think back to the 1990s. Kashmir was burning and turn to today, more than a Million visitors have visited Kashmir, much more than even Pakistan gets. There is Democracy, there is overwhelming response to Elections. 10 years ago this was unthinkable!
We all have read how Tourists have stopped visiting Kashmir in the 1990s and even early 2000. Today, people I know are going there or are planning to go there for vacations.
India will be India, it'll finally integrate Kashmir. Hindus, Buddhists, Shias of Kashmir cannot imagine a future in Pakistan. The remaining ones will forget about rebellion once Kashmir becomes the hotspot for Tourism in India, it is well on its way..

I'm Indian - ethnically dardic Kashmiri Pandit, and a follower of Kashmir Shaivism. This Vedic culture has spread across India, so what are you talking about? I'm glad my ancestors did not succumb to the systematic forced conversions of the Pandits, the original inhabitants of the valley.
Repatriate the millions of Pandits who have been driven out over hundreds of years and then let's take a referendum! Every Pandit will proudly say he/she is Indian.
I don't care for what the author says but the fact is that Kashmir will remain a honeytrap for Pakistan. River waters of Jhelum and communal brotherhood against infidels will force them to come again and again in some vague hope of securing a local rebellion to turn the tide against Indian state. It is a simple logic. Indian State knows this very well.

@Syed Jalal Kashmiri: Indians are not brainwashed. Had they been brainwashed, Kashmir would have been sorted out long back like the Chinese have done with Tibet and Xinjiang. We have with us a document that clearly states by J&K's legitimate Maharaja (as recognised by the Britain, the sole authority that granted Independence to most of Indian subcontinent in 1947 ) acceded the princely state of J&K to India. Now all the inhabitants over there are living on land that legally belongs to Indian State. Those who wish to be part of Islamic world (whatever that means, given the fact that India herself hosts third largest Muslim Population in world) and see India as a foreign nation, should leave that piece of Indian land and go & join their brethren elsewhere. Nobody is stopping them. The land will remain with India, whether you remain with India or not is your choice.

If you just go out of Srinagar you will find the ruins of Avantipore which belonged to Mauryan period. Syed a name surely converted Brahmin. Took the name Syed to maintain the caste factor.

I am impressed with the knowledge, analysis and openness of the Author. It is always a pleasure to read his pieces specially because he usually treads the unbeaten path. It would have been better though, if he had researched India's position completely without bias.
I would suggest to the author that time is ripe for a similarly forthright and revealing piece about the Baluchistan headache, which I shall look forward to.
@syed jalal kashmiri......then why dont u go to these places and live there.....thou places u have named are the purest places in the name of god and are among the most developed nations......there u will get trainings along with great job and employment..not unlike India which is a third world country and like some of my kashmiri collegaues who want to live in Gurgaon,NCR....want to work with accenture and TCS but will only live and eat with muslims because this makes them impure.......be broad minded and see world with people who hold equitable and fair rights not on basis of relegion but on basis of humanity......the armies are meant to tackle people...If u people beleive that Indian army should watch terrorsit kill people and army in the name of relegion then u are fool....armies are meant to tackle such situation be it terrorist or freedom fighter of balochistan.

As per the year 2001 census in India MUslim population was 138 million comprising 13.4% of the population. data of Indian census year 2011 is not declared about the religious population still. which is expected to increase more than 14.4% which is a conservative estimate by PEW.
@Travel_Tart: No. Muslims in India is 10.97% of total Muslim population of world . Pakistan has 11 % of Muslim population of world . So its almost the same ,Pakistan has slightly more Muslims.
Kashmir is for Kashmiris, not for India. India's problem has been their disrespect of our religion, our culture, our language, and our independence. Kashmir is not a problem, Kashmiris know exactly what they want. It is India, and more than a billion brainwashed Indians, which do not respect the dignity, honor, and humanity of Kashmiri people. Kashmir never was, nor ever will be a part of India. Kashmir is part of the Islamic world forever, and closer to Pakistan, Afghanistan, and Iran than ever will be to India. Indians do not belong in Kashmir. Get out and take your foreign culture with you. You will have to leave one day, you cannot suppress the will of the Kashmiri people forever.
Dear Author: A practical write-up, especially from the Pakistani point of view. But some things were left unsaid:
Sheikh Abdullah supported accession to India and wanted "special" status in return. He turned on Nehru when he thought he didn't get that "status", i.e. in 1953. Many analysts believe he hardened his stance to counter the religious hardliners. Something similar to what Conservatives in UK do - take a hard line on "immigration" to counter BNP. Maharaja Hari Singh didn't sign the instrument of accession just to counter Kashmiris trying to overthrow him. That is a misleading conclusion. He signed the instrument on 26th October 1947, several weeks after the invaders (lashkars + Pakistan army + Jihadees) entered Kashmir. He signed it when he lost whole western and northern part of his kingdom and Sri Nagar came under threat. As you see, Pakistan army is an old hand at covert operations.Otherwise, your key thesis is correct (for Pakistan). But can we ignore the fact that Kashmir valley is not "Jammu & Kashmir"? What about a million kicked out of thier homes by "freedom fighters"? Very clever by the Editor in trying to play innocent... but too little, too late. The fate of Kashmir is already sealed... the proverbial "trying to shut the stable door when the horse has long bolted!"
I would wonder that, should a legitimate plebiscite be held, if the population in Kashmir might vote to have THEIR OWN COUNTRY, rather than joining either India or Pakistan.
Get over it. It may be India's problem or it may not be. India has many 1000s of problems and this is just more to the basket of problems. Unlike in Islamabad and Rawalpindi, the Kashmir problem does not worry us much or cause any sleepless nights in New Delhi or Mumbai. India is not going to give Kashmir to Pakistan, UN resolutions or otherwise. There are many UN Resolutions that remain unenforced and you can add this one to that list of "will never happen". You can never win a war with India and take Kashmir. And you will not guilt or shame India into doing it either. So accept the reality - Kashmir was a part of India and will remain a part of India

@M Zaiuddin Sir you are correct about lashkars, 1965, Jihadis and Kargil. Well done. Where your judgement is clouded is when you say India cannot keep Kashmiris under control. India does not want to keep people in bondage. This is a serious misconception in many an opinion makers' minds. The die is cast. Pakistan will keep what it has got and so will India. There is no alternative. Good luck to both countries.

you mean to say that ignoring the principles of two nations theory ( which is proved wrong) India has a Population of Muslims more than that of Pakistan. The writer conveniently forgets that the same Sheikh Abdullah, the so called Lion of Kashmir, the most popular elected leader of Kashmiris and of national conference, agreed and endorsed Maharaja Hari Singh's decision to sign the instrument of accession with the government of India, on October 27, 1947 in response to attack by Pakistan led and supported laskars.

Woh Woh Woh!!! What did I just read?? An honest presentation of history by a Pakistani Writer on a Pakistani Newspaper. You are absolutely right in saying in saying it is India's problem and Pakistan shouldn't interfere in the internal problems of India. Sending Jihadis to Kashmir will serve no purpose. Technically as per India Independence Act, only 2 nation were to be formed India and Pakistan. There was no mention of Independent Kashmir. Also like you said Legally Kashmir was annexed to India thanks to Pakistan. It would better for Pakistan to look after its own territory(which it is not able to handle) instead of fighting for Kashmir.
