A two-member Lahore High Court (LHC) Rawalpindi Bench election tribunal on Monday declared Pakistan Tehreek-e-Insaaf (PTI) candidate for NA-71 Ayla Malik ineligible to contest the by-polls because of fake education documents submitted to the Election Commission of Pakistan (CEC).
A two-member tribunal comprising justices Mamoon Rasheed and Ayesha A Malik declared Ayla Malik ineligible based on the Rawalpindi Board of Intermediate and Secondary Education’s (RBISE) finding that her intermediate (FA) degree was forged.
Advocate Zameer Sheikh, the lawyer for petitioner Ubaidullah Shadikhail, a PML-N candidate who challenged Ayla’s education credentials, argued before the court that the FA degree of the candidate is fake and this was also confirmed in a written reply from the RBISE.
He said the degree Ayla submitted actually belonged to a male candidate — Imdad Hussain — who ironically failed in the exams. Dr Babar Awan, representing Ayla Malik, countered by saying the court should summon evidences.
However, Sheikh said that it was not mandatory under Article 85 of the Evidence Order 1984.
Earlier, a probe was conducted after Shadikhail brought Ayla’s credentials to the court’s notice.
Meanwhile, the tribunal also declared Inamullah Khan Niazi, another candidate from Mianwali and a cousin of PTI Chairman Imran Khan, ineligible because he is a bank loan defaulter.
