The court sent the issue to the Chief Justice of Islamabad High Court, asking him to issue orders for the formulation of a new bench.
On Monday, a large group of lawyers had their statements recorded before the Shalimar Police Station against former president Pervez Musharraf in judge’s detention case.
Their statements cited that former president Pervez Musharraf had imposed emergency on November 3, 2007.
Earlier, on April 18, Justice Shaukat Aziz Siddiqui of the Islamabad High Court had rejected Musharraf’s bail plea and ordered his arrest. On May 22, a trial court rejected a second bail plea by Musharraf after the IHC shot him down.

It is only right that this 'judge' should not sit on this, Musharraf case, bench in view of his highly politicised pedigree. In factt, having now seen this judge's CV I would urge him to totally excuse himself from sitting in this, or any other, superior court. Those who have participated in selecting this rabidly political individual for sitting in the Court, owe the nation an apology for such a regrettable selection.
Justice Siddiqui should have directed the intelligence agencies to find out those running smear character assassination campaign against him, nabbed the culprits and given them examplery punishment for contempt of court.
No Doubt, This man should convict, but symbolic..
Lets be Fair here, there should be a parallel case on Chief Justice for action on 12 Oct 1999.

@assad: OK, I could be very wrong in assuming the Establishment involvement here in the above comments, however my question in regard to Musharraf remain unanswered, it does not matter whether any one is talking about his take over in 1999 or not but the facts are he has violated the Constitution of Pakistan if you care about your Constitution in the first place. It seems none of you care about the constitution.

As for your amazing justice, he was a party to the Musharraf issue way before he decided to sit in judgement of the General. He was the attorney for the Lal Masjid maulana and has had quite a bit of exposure to the anti-Musharraf rhetoric from no less than the biased Lal Masjid crowd. Any lawyer worth his grain should know that after defending an antagonist of Musharraf's government, he should be the last sitting in judgement of Musharraf. So perhaps thinking through these things is the first step in doing things logically and correctly.
Lastly, he took over Nawaz Sharif's government but with full support of the judiciary. Can you prove that otherwise? Can you not see the PCO judges sitting on the Supreme Court bench? If this is about justice then why is the takeover of 1999 not being discussed and only the 2007 emergency? Have you ever heard of opportunistic rascals? Well that is what these folks sitting in judgement of Musharraf are.

TTP judge refuses to try a brave leader
It seems like Musharraf's trolls are here in large gathering, one should look at his record and decide whether this man should be freed. Did he or did he not took over with the barrel of gun from Nawaz Sharif, an elected Prime Minister, did he or did he not impose emergency rule on November 3,2007 which was in violation of the Pakistani constitution if any one care to care for the Constitution. Did he or did he not incarcerated the higher judiciary with out any constitutional authority. Perhaps justice Siddiqui recluse himself now because he was one of the justices who was confined to his residence, it is clear that he could not pass judgment to sentence Mush in fair way because he was a victim by Musharraf and he should be commended for his uprightness instead of being abused by these troll and who knows how many of them are working for the Establishment. By the way refusing a bail by a judge is not a sentence.

I dont see a tad of wisdom in your comment. General (R) Musharraf was the best leader Pakistan ever had (after Jinnah and Liaqat Ali Khan). His only crime is that he is a patriot and puts Pakistan first despite coming from a minority ethnic group. The others, be it Generals or Civilian Politicians, have not been arrested despite their glaring crimes because they come from majority/recognized ethnic groups. Sad state of affairs.
@Ahsan, I listened to Qadri sahib and most people of Pakistan did, only the message did not knock in to the ears of one man and his supporters IK and PTI. they thought by taking a solo flight they will be able to defeat this system, that did not happen earlier elections were manipulated by the Khakis now Judiciary has taken that role. Neutral and Just judiciary is the need of the day not an independent judiciary that sets the rates of tomatoes and potatoes and gas. This is not judiciary's job to check, its the parliament to decide and the opposition to keep the executive in check. If that is not the case everyone suffers. If judiciary takes on the role of the executive and makes its decisions based on popular slogans and what people do in the streets the country's governance suffers, institutions suffer, democracy suffers. Even the article 6 cannot be applied by the court it is quite clear in the constitution of Pakistan which i quote as under: Procedure for initiating article 6 1. Procedure: No Court shall take cognizance of an offence punishable under this act except upon a complaint in writing made by a person authorised by the Federal Government in this behalf

The Returning officers (judicial officers) were following instructions from the top i.e. not to disqualify the corrupt politicians as some powers wanted to execute their agenda. Only GOD know what ( I hope its not the Pipeline or gwadar or the nuclear roll back ....)
Alas Qadri Sahib was right but no one listened including the self righteous Media Anchors. Kash Hudabia suger, Nishat power, MCB privatization, Itifaq steel , CDA plots, LDA plaza fires, and so many more cases are put up for public scrutiny for us to know the true worth of our leaders.
Reality is taking its course. The fake judges and fake cases have no feet.
So when is Musharraf leaving on a one-way ticket to Dubai?
Has anyone bothered to ask the judge - why? Hard to have justice anywhere when judges are intimidated/threatened and if that's the case here then many of the commentators should apologize to this judge.
Nothing has changed in the judiciary after the so called lawyers movement which promised to bring about revolutionary changes in legal and judicial matters. Courts are filled with unheard cases while petition factories are working overtime. Things have gotten only worse.
The whole bench and the case is a fake one. Musharraf should immediately be released and the CJ should sent this judge home

This shameless man should have respected the norms of justice and reclused himself in the first instance. Now it is just plain old hypocrisy nothing else and it just won't diminsh the damage he already caused to basic priciple of fainess and justice and impartiality.
This judge after taking his revenge now excuses himself from the bench. Who will do his accountability for inserting the 7ATA on the former president, taking him out of the election race and also brought humiliation to him. Musharraf is a true leader and Pakistani patriot I wish all the best. He should stand his ground and fight these cases for in it lies his survival if he has jumped in to politics now is the time for him to be the a real awami leader. His support is brewing back in to action. Social media is enough for this N government to pin it down soon these pseudo intellectuals on the media will start acknowledging musharraf back again. I am sure and I have my full conviction in it ameen.
Every Citezen of Pakistan has right to fair and free justice, even Musharraf who did not care much about the rights of the people. But we have to establish justice in Pakistan. In any country the rule of law must be enforced by the judiciary and in here there is no justice only rule of jungle.
Fake cases would have no ground against him, How come these judges can hear a case which is against themselves ?? Prejudicial.
