Although the petitioner had not made the PTA a respondent in the petition, the judge advised him to do so as it was also responsible for providing the opportunity of live speech in Pakistan from abroad.
Along with including PTA in the petition, the petitioner also filed a civil miscellaneous application for interim stay on Hussain’s speeches.
The application would be taken up on the next date of hearing which would be decided by the registrar’s office of the LHC within two weeks.
Advocate Fayyaz Ahmed Mehr had filed a petition on Wednesday, stating that Altaf Hussain is a foreigner claiming to be the chief of MQM and his demands are against the constitution of the Islamic Republic of Pakistan and also against the ideology of the country.
On May 12, during Altaf Hussain’s address to his party workers, he had threatened the Election Commission of Pakistan (ECP), establishment, media, workers of the political parties and politicians and also demanded that Karachi be detached from Pakistan, said the advocate in his petition.
The petitioner termed it a “conspiracy” and a move to destabilise and create unrest in the country.
He said according to the Political Party Order 2002, only an individual belonging to Pakistan or association of citizens of Pakistan can form, organise, continue or set up a political party in the country.
The petitioner stated Altaf Hussain is not a citizen of Pakistan and cannot claim to be the chief of a political party.
He added that the MQM Chief’s speech was anti-state and amounts to treason, therefore he [Altaf] should be brought back to Pakistan and be punished in accordance with the law. He also said that those working for Altaf should also be punished in accordance with the law.
He had also urged to stop all media outlets from giving coverage to the speeches of Hussain.

All the trolls above, When the matter is in court let the court decide simple. Secondly somebody tell the stupid petitioner that there exists a dual nationality agreement between UK and Pakistan, and by definition of that A dual national has all the rights that the nationals of both the countries enjoy. But I like the petitioners civil strategy instead of making political statement he filed a petition in court unlike IK who is after UK to deport AH, even though none of the courts in Pakistan have found him guilty on any aspects, on what grounds has he demanded the deportation ?
@ khair kwah...two nation were drown by punjabi general in bay of bengal inon 16 dec 1971
Seems like the lawyer is lost in translation. He said in the speech that if you dont accept the mendate of karachi then separate it from rest of Pakistan. It is a figure of speech.
@Shah: Bravo. You seems to be patriotic MQM supporter. Keep it up unless you also got lesson.
All recent actions of Altaf Hussain is just a frustration. He foresee that MQM is losing control of Karachi and we are thankful to Imran Khan who voiced against Chauvinism of MQM and soon people will be freed to use their rights.
@S: Why should MQM not play the ethnic politics when in Pakistan nobody talks about anything but biradri and giraen-baazi? It would be one thing if MQM was going against the grain with this ethnic bakvaas, but when the entire country and all of is provinces are named and run on the basis of ethnicity, why should the poor Urdu speakers be left out? Afterall MQM came about in reaction to the racial and ethnic biases of the majority against them. May Allah help us move beyond ethnicity, but it is highly unfair for you to just single out MQM for ethnic politics.
Leave aside what is happening in the court, but one is rather amazed that the above comments have been posted by ET,because most of them do not qualify in accordance with ET"s code.Ironically saner & moderate comments do not find space in these columns.Pity !
It's not a Punjabi court, its a court in Pakistan. MQM has no platform but to play ethnic politics. This country has moved on
The development in MQM by dissolving committees etc is being discussed on GEO TV totally misleading copied from GUARDIAN's article. BEWARE ALL this development will render thousands of workers frustrated and negative intentionally...that frustration creation is meaningful.
@RT: Bro, your analogy is completely flawed. Baloch nationalists demanding separation are neither involved in main stream politics (like MQM), nor they believe in Pakistan's constitution, that's why there is operation for last a decade or so. But MQM is in power for last 12 years (in fact in every govt), Their governor is in place for 10 years, they enjoy all perks and privileges, and high stature in the business of state, get preferential media presence, but on mere rigging allegations, they threat of breaking up Pakistan. Time to rethink and change politics of threats and blackmailing. Such tactics aint going to bring any good for them nor for Pakistan.
To all Racist folks please remember the most discriminatory QUOTA SYSTEM which was introduced for 10 years but its almost 40 years and still in operation!!!
We love Altaf, no matter what!
This should have been come from SHC............. or from a Karachiet Lawyer
@Disgusted!: @Modi: Another case of made up accusations like that Jinnahpur claim which fell flat on its faces because of the lies told about the MQM. It would do Advocate Fayyaz Mehr a lot of good if he only understood what was said and what it meant.
Punjabi courts dont have time to take petitions related to elections rigging but have time for these petitions
Before it was Punjabi establishment and now PUNJABI JUDICIARY taking affairs in their hands against the oppressed communities of the country...no wonder Karachi is being pushed back to 80s.
one must see his speech on youtube in 2007"Blunder of blood, creation of Pakistan" then judge yourself about AH
G.Khan UK
It's a fact that a majority of Sindhi urban population (urdu speaking) carry a deep scar of memories from 1992 and before that...the incidents of pakka qila and qasba...it's not about MQM...it's an ethnic issue. And deep down buried is a sense of deprivation, anger and isolation which could ignite any unorthodox movement anytime if pushed so much by the media and rest of the Pakistan. It's a fact which everybody tries to avoid mentioning but it's a fact!
@Disgusted!: I highlighted by saying " from my political understand" Doesn't mean I am right, I can be wrong. Why are people so quick to show others they are above them?
Now the judiciary is playing politics! No wonder Pakistan in a mess
So it began .Again .Punjabi chauvinism showing its true color .
In one of his tours of India didn't AH speak against the two nation theory?
It is extremely disappointing to see the courts becoming a party to it. It seems they all want to make MQM Mohajir Qaumi Movement again, and if it is, so be it. MQM of 18 March 1984 will be revived.
@shah: Oh! So sweet of AH and so innocent of you!!!
Its ON
Well said and must be pursued to an end in the court of law.
A patriotic move against the only non-state party within the state.
All he said if you do not accept the mandate of MQM you should seperate Karachi from Pakistan. From my political understanding altaf passed a clear massage to nawaz sharif not to repeat the mistake of early 90s operation against MQM. There is no point in filing these petition it will only cause disruption.
So "Advocate Fayyaz Ahmed Mehr" is not afraid of being killed. Brave God bless him.
