The right ground: Court seeks record of commercial activities in residential areas

According to the Urban Development Ordinance 2011, residential property cannot be used for commercial purposes.

The Peshawar High Court (PHC) has sought records of residential property allotted for commercial activities in University Town.


Chief Justice (CJ) Dost Muhammad Khan and Justice Roohul Amin issued the orders while hearing a petition filed by Dr Fazl-e-Muqeem against a restaurant at the Town Ladies Club. According to the Urban Development Ordinance 2011, residential property cannot be used for commercial purposes.

The restaurant is flourishing unchecked in a residential area, despite court orders against it, said Tariq Afridi, counsel for the petitioner.

Since the court passed clear orders in 2009 and 2011 to prevent business activities in places of residence, the bench asserted it would not allow such things to transpire.

It directed the chief officer of the town and secretary local government to produce records for residential property being apportioned for commercial purposes. The record should carry details on the procedures for leasing out the property and tenure for the lease.
