“The interim set up is basically responsible to conduct free and fair elections,” Qadir explained. “[Government’s] reply may put a question mark on its partiality.”
Justice Jawad asked attorney general to submit this in a written form so that the court can pass an order regarding it.
“The government is not following the court’s orders. We expected the interim government to be more committed to the cause,” Justice Khilji remarked during the hearing.
Earlier, the attorney general had requested for more time to submit government's reply but it was turned down.
A two member bench, comprising Justice Jawad S Khawaja and Justice Khilji Arif Hussain, was hearing five identical petitions, seeking a trial against Musharraf for high treason and subversion of the Constitution.
The bench had earlier raised the question that why had the federal government not taken action against former President Musharraf for violating the Constitution?
The bench had also directed Attorney general Qadir and Acting Law Secretary Sohail Qureshi to submit a detailed response with regard to the steps taken by the federation to initiate criminal proceedings against Musharraf.

@mian riaz: I agree with you Mr. Riaz. But the case was initiated no matter constitution is violated. This is 'cut off your nose to spite your face'.
BTW, By and law, Federation can initiate treason case . But they refused to initiate any treason charge against Mr. Musharraf. Judge try to understand and move on to better cases.
Treason cases are initiated by the state and not people. In this case state or Federation refused.

It is none of the court business to force federation for reference for treason case against Mi. Musharrf. Justices please, are you prolonging the issue and wasting time and money or sincere in solving the case.
It is ironic that all of a sudden PPP attorney general becomes the darling of military loving crowd!
The Attorney General reply was apt and spot on. Did the honorable judge not knew the limitations and duties of a care-taker govt ? Not good signs for the former President who has to swim against the current.

Wonder, why can't the Attorney General remind the partisan folks running the judiciary that they have no business in pressurizing the Government to open or close a case against any citizen, this sole prerogative of Government of Pakistan. Period.
I think the judges are crossing the limitations. They should act if the Federation ask to act and not vice versa. Judiciary is loosing its respect. They should concentrate on solving the cases and not running the country.
Musharraf's first success.......
Keeping in view the wastage of judicial time for prolong and never ending political issues, I suggest there should be 2 supreme courts with distinct functions. Or atleast 2 separate benches within the existing court. One should only deal with political issues and the other should deal with the remaining. We already noticed how much time was wasted in case of letter to swiss authorities. What was the outcome of that? There should be an accountability of these judges as well who get paid in millions out of the tax payers money

Why not start suo moto ? Or may be ponder why governments are not able to comply with supreme courts orders?? May be supreme court has taken the role of chief executive without any liability
prediction: court will not be happy and will keep on chanting until Musharraf is tried under article 6 and their personal vendetta come to an end. SC will be stuffed and satisfied only after govt provided them what they want, not what law wants.
