The US State Department filed the statement in the Eastern District Court of New York, in response to a wrongful death suit brought by the American relatives of the victims of 2008 Mumbai terror attacks.
In response to media queries, the spokesperson for the Indian Ministry of External Affairs said, “It remains of vital importance for India that justice is done and that those who organised and perpetrated this horrible crime be brought to justice, irrespective of the jurisdiction under which they may reside or operate.”
“Our position has been made known to the US consistently,” the spokesperson maintained, implying New Delhi had expected the US to act differently. He asserted that Washington would have to explain a stance which appeared ‘at variance with its stated objective in the war on terror’.
“India is not a party to the civil suit filed in the Eastern District Court of New York. The details of what was conveyed to the court by a sovereign government are a matter for that government to explain,” the spokesperson added.
“From our perspective, this decision is a matter of deep and abiding concern. The leadership of the US has publicly stated its commitment to counter terrorism, to dismantle the terrorist infrastructure in Pakistan and to bring those responsible for the Mumbai terror attacks to justice. In this context the decision of the US authorities in this case is a cause of serious disappointment.”

Well its very rare you see a bunch of hypocrite indians moaning for justice on mumbai attacks which were planned inside their own country.Any person with an ounce of brain knows mumbai attacks were planned by india's own terrorist agency which is indirectly responsible for 98% of the suicidal attacks in pakistan.TTP and other terror groups are being funded by RAW for which we have so many evidences.Perhaps pakistanies have grown use to of the fact that indians are not man enough to face us on the battlefield so keeping in view that fact their demand seems to be reasonable.If india thinks that 1971 can repeat itself then i feel sorry for them.Even they are interfering in Balouchistan,hoping to break pakistan into pieces we know that.Pakistan is a nuclear state and any country daring to challenge its authority and sovereignity will burn in ashes.We have been taking soo many punches from neighbours and europeans being a frontline state in a war against terrorism and we have bled enough.Final knockout blow shall be ours! The complicity of ISI in Mumbai attack is a foregone conclusion. However, US has decided to avoid another diplomatic row with Pakistan keeping in view of the agreement with Afghan Taliban that it wants to reach before 2014 in which the latter shall act as a facilitator. India knows quite well that no action would be taken against Hafeez Sayeed and Pakistan shall not stop cross-border terrorism either therefore it has put adequate defence mechanism along the LoC and other places which has shown good results in Kashmir and elsewhere in India. Moreover, Pakistan is already on a self-destruction mode as it continues to patronise terror organisations and taking no action against TTP has taken the country almost on the verge of collapse.
All Pakistani frens, Modi, your super villian has won elections in indian Gujarat for third time. So he automatically becomes potential PM candidate.
Under his stewardship, even if things may or may not change much in India. But, Pakistan-India relation will never be the same.

It has spilled muslim blood and sown seeds of hatred. Now the seeds have turned into a tree and giving fruits. Stop complaining and eat the fruit. Only you Indians are to blame what is coming your way. These were only 10 men, thousands are waiting in the wings, stop them if you have guts.
All terrorism in south asia will permanently end if India gives freedom to Kashmir. That is the root cause and a big injustice.
Not surprising. By law if outside agencies were found responsible for killing Americans, as many Americans have died in Mumbai attacks, those agencies should be sanctioned and American Govt had to sanction the country too.. As 2014 is approaching sanctioning Pakistan is not a good idea and hence, this move.
Just a case of bad timing. I am certain sanctions will be placed and Pakistan bullied into submission once the troops leave in 2014. The remaining troops will be supplied using the Northern Distribution Network, thereby removing every bit of leverage Pakistan enjoys over the US.
@jami: USA is friend to none,as Pakistan was used against India,Afghanistan,Iran and Russia till 1999 and now USA is trying hard to use India against China and Pakistan but Indians not fools like Pakistan who have no pride and nationalist approach.

US will rather keep this can of worms closed. Otherwise next you will see cases filed against every spy agency (including CIA, RAW and MOSAD) in the world. I don't see any government ready for this. Not atleast yet.
India too well understands this and will only restrict to lip service, both for consumption of local and international audiances.
India has not milked the Mumbai attacks nor has it benefitted. It only resulted in stopping further terrorist attacks on India from Pakistan. However, Pakistan has lost financially much more than India due to these attacks. The financial costs to its economy may even be several billions of dollars. Even in terms of loss of human lives, Pakistan may have lost more than India due to these terror attacks. International action has forced Pakistan's export of terrorists and as these terrorists are not able to move out as easily as they used to, they are carrying out daily attacks within Pakistan itself. This is what Pakistan is calling "milking".
Although the State Department has said ISI enjoys immunity, things may change in the future. Pakistan's Supreme Court acting on its own President and disqualifying its Prime Minister who has asserted the President's immunity may come to haunt Pakistan later.
Who needs to cause any damage to Pakistan? They would do it themselves very efficiently and effectively. It is a country that has the largest number of suicide bombers anywhere in the world. Some of its own leaders like Sheikh Rasheed and others has claimed that TTP has over 10,000 suicide bombers in Pakistan. No one can damage a country of suicide bombers more effectively and efficiently than that country itself. Pakistan shall keep protecting these terrorists and they shall keep destroying Pakistan itself.
Importantly, India is more interested in getting Hafiz Saeed than ISI. The warrant from US court against him is still in effect. US will get him one way or other. May be even ISI will help US to get Hafiz Saeed, dead or alive, as he is now more a liability than an asset for Pakistan. Many go missing in Pakistan and one more is not going to make a difference. We all know Musharraf handed over Afia to US. Khalid Shaikh Muhammad was also caught and handed over to USA by Pakistan.
Indians are right in creating a hue and cry about this incident. After all, every loss of innocent life is quite tragic. But I think they do not have any credible evidence that would convince the international community about Pakistan's (or even Hafiz Saeed's) involvement. They hate Hafiz Saeed because of him being outspoken against India in general. If there were an evidence, India definitely had shared it with US at least (after Pakistan's alleged denial) but they didn't apparently. US putting $10M award for any person providing the evidence against Hafiz Saeed is a proof that there is no evidence whatsoever! Accusing someone on media, rallying public behind such accusations is no evidence in the court of law.
It's more of a media war between Pakistan & India. Indian politicians once in a while throw a statement about Pakistan's involvement to appease the masses and to cover their incompetency. Same as Pakistani politicians. Mumbai attacks were tragic, so are the attacks from Baloch nationalists killing innocents. India blames PK for Mumbai tragedy, Pakistan blames India for supporting Baloch Liberation groups that also kill innocents. None seem to have any evidence. And the public from both countries is just emotional.

@Kamran: Dear friend, how come that asking for action is milking?It is the unwillingness and inefficiency of the pak authorities that keep the indians go on with their demands. If it goes overboard who is responsible? Your own helplessness about the non-state (and partly state-blessed) actors is not an adequate answer when it affects a foreign country.
This is the stand of the State Dept., but the court will rule if it is so or not. My thinking is that the court will decide otherwise.

US stance is understandable. It cannot set a precedence whereby its own agencies may face problems in the future. If India is powerful and resourceful enough, it should be able to retaliate directly on the perpetrators. If India feels that it has a prima facie strong case against the ISI that can stand tough legal scrutiny, and also has the resources and the necessary technical and legal expertise, it can file a complaint directly with the UN.
As our wise Reham Malik said that babri masjid incident instigate simple people to do wonders without involving state actors. Had our ISI been so good they would have either found OBL or did not let any one come near him.
