Woman jailed for not terminating Facebook page

KENTUCKY: A woman was sentenced to two days in jail after she refused to shutdown her Facebook page despite a judge’s order, reports Wave3.com.

The woman who got a DUI after she hit a car with teenagers in it, posted to her Facebook page saying: “My dumb*** got a DUI and hit a car LOL.

Apparently, it was the LOL that disturbed the people who were hit by the car and as a result, the judge ordered the woman to terminate her Facebook page.

When she did not do so, the judge sentenced her to two days in jail on contempt  charges.

She has now apologised to all parties involved as well as the judge.

@kumail: Yes, might be overbroad. The woman appears to have been convicted of a crime, given a token sentence (time served), and likely was released on probation or parole. Probation usually has conditions attached, and new conditions related to the crime and justice can be added as long as the person remains on probation. Hence, ordering her to take down the page that offended the victim's family might be conducive to her reform and to respect for justice, and thus allowed as a constitutional restriction of free speech due to her continuing criminal term, but ordering her to close her Facebook account entirely might arguably have a more questionable connection, and thus might be declared overbroad. But I think it most unlikely that a reviewing court would overturn the sentencing judge's discretion on this one.
