With due respect, I write for the second time in two weeks about a most horrific matter: that of a former member of our National Assembly and many times minister, calling upon My Lord the Chief Justice of Pakistan to commit murder.
I know we have plumbed the depths in this God-given but now surely God-forsaken country over the 66 years of its existence: from the unjust and cruel way in which we treated our East Pakistani brethren; to the killing of innocents by the ‘bad’ Taliban and the genocide of minorities by self-same Taliban and their cohorts that we see every single, tortuous day; to the fact that we are now an international pariah, the mere sight of our green passport sending immigration agents across the world into an almighty tizzy.
We have seen generals and politicians and bureaucrats violate the Constitution and misrule and steal; we have seen some of our great national treasures like the railways and PIA steadily driven into the ground; our archaeological treasures and rare books stolen and sold abroad for a pittance by members of our so-called ‘elite’. We have literally seen this country rent asunder by adventurists and carpet-baggers. Indeed, we have seen a senior retired air force chief-turned-politician say that he would personally hang an elected prime minister from the Kohala Bridge.
We have seen, too, a prime minister shot in broad daylight and his assassin conveniently shot dead by a police officer who ‘happened’ to be standing by him; an elected prime minister hanged in what the world believes was a complete miscarriage of justice, nay cold-blooded judicial murder; and another jailed in Attock Fort by a usurper general and then exiled.
But never, ever, have we seen or heard a so-called ‘senior politician’ asking an Honourable Chief Justice of Pakistan to commit murder. On the night of August 13, 2012, Shaikh Rasheed Ahmad (aka Sheeda Talli)’s exact words were: “Janab Chaudhry Iftikhar Saab; Janab Chief Justice Saab, kill the bastard before he kills you; kill the bastard before he kills you; kill the bastard before he kills you’. The link to the video clip. Because your time is so precious My Lords, kindly watch the video for just 29 seconds: from 03:50 to 04:19 and you will know all.
Now then, whilst it is perfectly clear to most who heard the man who he was referring to as ‘the bastard’, it is for you, My Lords to find out, from him, who exactly he meant. And then to provide that person the protection that he needs from this man, for if he could exhort the Chief Justice to kill him, he could hire a professional hit-man to do the deed. Far more importantly, of course, is the fact that it does not really matter who he meant. Indeed, what is hugely critical is the fact that he has personally and publicly (no matter that the jalsa turned out to be a jalsi) called for the murder, no less, of someone at the hands of the Chief Justice of Pakistan himself, no less. A clarion call heard by hundreds of thousands of people all across the world through the medium of TV and internet.
I have to say My Lords, that for a hyper-sensitive and media savvy and contempt conscious Supreme Court whose suo motus and contempt notices have flown hither and yon with alarming and deadly frequency, even netting someone caught carrying two bottles of liquor, missing this huge and utter contempt of court is mystifying to say the least. I must also add that we have even seen an elected prime minister thrown out on his ear on a contempt of court charge, and yet nothing so far in the matter of Master ‘Tulli’?
Which reminds me: Several times recently, I have written about another contempt of court committed by this same man when he said in a TV interview that Chief Justice Iftikhar Mohammad Chaudhry used to stand outside Lal Haveli waiting to call upon him to lobby on the CJ’s part. The exact words were: “Chaudhry Iftikhar ko lanein ke liye hum lobby karne waley thay; woh khud burra tez aadmi tha; do do ghantay Lal Haveli kay bahir kharra rehta tha.” When an incredulous anchor asks him, “Iftikhar Chaudhry?”, “Tulli” replies, “Iftikhar Chaudhry; Jab woh mujh se barre kamon ki tarraf parrh gia to mein nein Chaudrion keh hawaley ussay kar diya; phir Chaudhrion ney apne se barray size kay hawalay ussay kar diya; iss jagga pohunchney kay liye uss nein bohut barri lobby ki”. And now, where else but to the latest outrage and more: the killing of 24 innocent people, 21 Shia and three Sunnis who tried to protect them by not letting on who was Shia amid slogans of ‘Shia kafir’ and ‘Sipah-e-Sahaba Zindabad’; the arrest of an eleven-year-old Christian girl with Down Syndrome for blasphemy in the nation’s capital; and the kidnapping and stabbing to death of a Christian boy in Faisalabad whose body was then burnt by the perpetrators. My head hangs in shame.
Suo motu, My Lords?
P.S. Does it take rocket science to see where the killers of the Shia get their sustenance? The Sipah in its new incarnation is a leading member of the Difa-e-Pakistan Council. And, er, we know who is behind that!

Good to see that there are people who are still prepared to raise their voices against the recent atrocities committed in the name of religion against minorities - Muslim and non-Muslim.
Not only should our collective heads hang in shame but we should also fear what this society is becoming and where it will lead us if the current situation does not change.
I for one am fast losing hope that this society even has the will to correct itself let alone take concerete steps to do so. I cannot even say God help us because God only helps those who help themselves.

Mr Shafi is absolutely correct. This PCO chief justice should immediately prosecute Sh Rasheed for inciting murder of the country's President. But the CH won't listen. He is busy acting out his fantasy of a political leader, giving speeches on everything that doesn't concern the duty of the judiciary, and is busy protecting the illegal wealth of Rs 9200 amassed by his family through abuse of his high judicial seat as alleged.. Why is the CJ blocking this investigation of corruption of his family?

Sir, giving Sk. Rasheed importance will prove counterproductive. On other issues of governance would it not be correct to call on the government to do its job or is this your way of saying that this government is a shambolic failure.
Most of the readers appear to have missed the point that the author was targeting the CJ, SR was merely the excuse. The challenge to exercise suo motos at least consistently or with merit was a taunt. I agree with the author, our CJ is heavily tainted by his dishonorable past and manifest bias in the present hence he cannot afford further exposure by summoning the noxious Sheikh Rasheed to answer valid charges.

I do not have any 'vengeance for your CJ. As an unbiased observer with no party affiliation in Pakistan I have certainly noticed that while CJ maybe independent, he is most definitely not unbiased. The arbitrary manner in which he chooses where he will take suo moto action and where he will not raises many red flags. The solution is not to take suo moto action in the case of Shia killings but rather not taking suo moto actions in other cases also. He should also avoid prioritizing petitions from certain parties that he favours while tens of thousands of cases are backlogged.
The sign of a good CJ is that he operates without fear or favour. This CJ certainly operates without fear but unfortunately not without favour. His favoritism is rampant and that compromises his credibility.
@elementary: I think perhaps you have misunderstood my stance. I strongly believe that suo motos are undesirable in ANY situation because they give executive authority to the judicial branch which is undesirable, As such, my comment does not advocate suo moto in this case either.
I was simply responding to your comment and trying to explain why some people are goading CJ to take suo moto - since you raised the very valid point that maintaining law and order is an executive function not a judicial one. It cannot be denied that CJ takes suo moto on any issue related to PPP or Musharraf (Atiqa Odho after all was of his party) but turns a blind eye to other blatant injustices going on in Pakistani society. IF you read my post again you will not that I was simply explaining the stance of those who are unhappy with the CJ regarding his completely arbitrary stance on suo motos.

Why always call the sou moto, have the courage to file a complaint in the court.
Fundamental problem is that neither Supreme Court nor government are doing their jobs. Why supreme court is under criticism??? Simply why they are not pushing for accountability of those people who are responsible for protection of innocent citizens???. I had no objection if a Prime Minister had sacked for not protecting peoples lives, it might force authorities to take some strict actions against culprits.

So Mr Shafi you expect somebody to be a rational human being when their actions portray a different picture. If Sh Rashid was a member of PPP then he would have gone to jail by now. So this time if the deep state disturbs the apple cart of democracy then it would be the end of it.
the same executive who's murder a politician has publicly demanded is expected to protect minorities. the executive never had the will and gradually lost the capacity to do much besides finishing its term. the legislature must decide before and after elections if its serious or just there for the socializing. SC should reform the judicial process in lower courts instead of conducting these inconclusive politicized media trials of islamabad residents.

The so-called writer seems to have some personal grudge against Rasheed. In the present political scenario Rasheed is a non-entity but by passing low, filthy remarks against him repeatedly the writer is lowering his own stature and has placed himself in the "C" category in contrast to the "A" category writers like Saroop Ejaz, Pervaiz Hoodbhoy etc. As far as the PCO CJ is concerned he has no morality. He jumps to take oath under PCO when he sees his future bright but refuses to resign when he sees the loss of status. What an irony and hypocrisy it is that himself a PCO he punishes other PCOs. Cases of "others" are heard on fast track basis but of "honourable son" is stopped indefinitely through "Uncles"

You are a 100% correct that protecting life and property of all its citizens - not just minorities is an executive function. I think that by taking a lot of suo moto notices in what was clearly an area in executive purview, this CJ invites criticism whenever he fails to intervene. His failure to take suo moto in this case is only being seen as a problem due to the completely arbitrary nature of suo motos in the past.

Nobody liked what "Tulli" represents but surely if there is a threat then its the "Executive" responsibility to investigate and prosecute. You should be writing why the government is not doing anything to protect the minorities, after all it is the responsibility of the executive. You should probably be extolling the society on why we have become so intolerant. Snarky columns like this against the judiciary do not really help.
As far as Sheikh Rasheed is concerned his comments at least from what you have mentioned above are personal remarks towards the chief justice. Your prime minister was willfully, publicly defying law. There is a huge difference. If the CJ were to go after him, it would appear as a personal vendetta. If you really do feel so strongly, file a case, take responsibility, instead of hiding behind a pen and then we will see how the court deals with the matter.

Now CJ is held responsible for all these horrific happenings which shouldn't have happened in the first place. And who is responsible for stopping these crimes? CJ or your beloved government of PPP? Against whom you never penned a single word. Your head must hang in shame.

very well written, CJ will take notice of your article but i am afraid he will be reluctant in taking notice of all the issues you mentioned....but keep on saying Suo motu, My Lord...may be one day he hear it.
Too sentimental. I agree with all the hype that was created but the article would have been much better if it had the Shia-Sunni killings, the excessive blasphemous enactments and the rise of a new radical order. They surely deserve immediate suo motto notices.
Verbosity is impressive and so are emotions, but article writing probably requires more than that. Kindly lessen the rant about Sheikh Rasheed, no one is interested in hearing it.
These days people are as interested in knowing the naked truth as much as the media is ready and willing to give it. The media has groomed the people through their cheap popularity gaining tactics and the people now anticipate to look to "fun elements" in the presence of a politcial personality.
Everyone knows that there is noone who can deliver their responsibilities effectively and without corruption. IN particular when the media anchors were exposed before the public themselves, there was no chance left to build the trust deficit.
People really don't care even if the CJ takes notice of Rasheed's words; they'll call it a cat-mouse game even if the CJ did that.

Except the last two paragraphs, rest was fluff. I completely agree that CJ should and must take notice on the current state of treatment being meted out to helpless minorities.
Sue moto notice is expected to be taken only on issues that have higher selling price in pakistan. anything related to islam and anti americanism usually attracts suo moto. Its not about justice in pakistan, its about demand and supply now where a chief justice observes a reaction against a particular issue and reactes actively if its hot in the market. shia killings are ignored because pakistan is full of ghariat brigade who is suffering from hyper nationalism and divert issues by crying about burma. in future we expect CJ to take suo moto notice on burma killings of muslims :)
