Speaking to the media after visiting the Sindh High Court, Naek said that running a government is the executive’s job, making a law is the parliament’s job while the court’s job is to ensure the implementation of the laws.
He, however, added that the government respects the Supreme Court and does not want any clash of institutions.

So go to court and claim Immunity?
President zardari
@Mirza
Blaming generals (though I agree army has done the most damage to our country) doesn't absolve Bhutto for all the crimes he committed in his regime. He was responsible for killing journalists and freedom of speech was virtually non-existent in his era. He was the one who started using religion in politics through his Islamic Socialism concept. His hunger for power was partly responsible for breaking Pakistan along with army and superiority complex of West Pakistanis. History of Pakistan didn't start from Zia-Ul-Haq there is a lot more to it that has been deliberately forgotten by PPP.
@Logic europe hull: voice of sanity at last
The Law Minister would do well to read Benazir Bhutto's views on this in her book ' Reconciliation ' page # 73.
Honestly speaking, law min is talking non sense. With all fairness, a discriminatory law like recent contempt act is not going to survive in the long run. How? If we are able to see the things in perspective. This legislation is nothing but a smart move to check the encroachment of judges in exeutive and legislative domain. Executive is eventually going to step back the moment judiciary retreats to its own spehere and restricts itself to its constitutional role.
If judiciary insists on running state affairs then there is going to be more of such non sense as a result of parliament's struggle to defend its territory. This is irrespective of whether it is PPP in power, or if PMLN comes to power in next round. And it is going to spill much bigger disaster than october 1999 catastrophe.
He is not saying president and Prime Minster are above the law. what he is saying is that President and Prime Minster's official decision have constitutional protection. And official decisions are those which are taken according to constitution. S, there is no ambiguity ...
@Logic europe hull:
Your name should be illogic europe.
@Raakhi Sharma:
Thank you for some genuine criticism from the other side of the border (I am assuming); I honor you as a neighbor.
Some are still expecting and talking roti, kapda aur makan from the PPP govt. They forget that ZAB who promised to do that has been hanged by the generals and judges. In addition they should not forget that only paid govt servants judges and generals with extensions are above the law in Islamic Republic of Pakistan. None of their actions have ever been questioned or punished. All the Islamic equality only applies to the elected govt not the usurpers and dictators. The ruling coalition should be ashamed of amending the laws, instead they should attack the SC like Sharif and abrogate the constitution like Ayub, Yehya, Zia and Mush did multiple times. SC would not punish in the above cases in fact aid and abate the actions. Even if the laws are clearly written still the PCO SC has divine rights to interpret them in their own way.
so much hot air in the comments. was Quaid-i-Azam ever challenged? anti-people FM Ayub Khan? anti-Bangladesh Gen Yah-yah? anti-ahmedi ZAB? mercenary Gen Zia? mercenary Gen Mush? ....why is SC above accountability?
when law becomes tyranny it is a duty to revolt, say wise minds.
The immunity is available by the Constitution for the actions/ omissions while performing the duty as president/ prime minister for the governance ( this immunity is available in all democratic countries for smooth functioning of the government) and not for the fraudulent and corrupt activities. Only head of the State ( i.e President) has the immunity so long as he remains the president. After his impeachment ( his removal from the post of President )only legal action/ proceedings can be initiated against him and not before.( Any legal action against the first citizen of the country(President ) is dishonor of the Nation hence this immunity.
So far the new law enacted providing total immunity from the contempt of court appears to be against the spirit of independent Judiciary and its power and may not be acceptable by the apex court.
This is a new theory of PPP that the President and the Prime Minister are above the law and the rest of the nation is under the control of law.
Interpretation of the law is SC's job, not Law Minister's.
Pakistan's constitution provides protection to the official decisions of President, PM, judges, cabinit and parliament. This does not mean that they are above the law. No one is above the law as per constitution. An absolutely wrong impression is being created by the PCO judges. If no one is above the law then all judges who validated musharaf's coup and PCO (including Iftikhar ch.) should be tried for high treason as per the constitution and Imran Khan should be tried for adultery as per Hadood law. Will they offer themselves to the law? Off course not.
Those who are talking about Islam should remember that in Islamic states the head of state has absolute authority over all state functions including judiciary. It is Khalifa who has unchallenged authority to appoint and fire generals and judges. will self proclaimed Islamists accept the same absolute authority in the hand of elected head of the state? Are you ready to do bai't on the hand of mr. Zardari or be ready to get executed? Remember as per Quran the rulers are appointed by Allah and absolute obedience of tge ruler (ol-al-amar) is mandatory.
We dont need to worry. The CJP is going to sort these guys out. The have not seen nothing yet-there are more surprises stored for these guys who don't want to follow the law
All of you sound sane till some PPP supporters shall appear to comment otherwise because they think PPP govt aré the víctims n judiciary biased.....
and these are the most educated intellectuals of current regime of PPP. Certainly, they have damaged the party beyond one' imagination.
@Sameer Malik: How many Muslims kings shave been punished by Qazis? Our most glorious period of khulfae rushda, three were assassinated followed by assassination of Hassan and hussain . Even today ideal state of all fundos, over or covert, saudi is kingdom not khilafat which is against tenant of Islam. They have not only immunity but powers to pardon any crime. Not only this but all oil wealth is property of king rather than state. What a hypocrisy?Because of this for last 600 years we are slaves. Even in India Muslim have fallen behind untouchables.
It runs in the party. Its founder used to think that too before he got a call from Tara Masih
Evwntually underdogs have started to bark Time to tell judges that they are not the emperors. They have to respect the executive that reinstated them People deserve to be free and soverighn
Yes court orders are irrevalant for the Ruling class
Heaven for culprits Pakistan, Just reach to the highest official posts of Pakistan and get the licence to corruption. You will always remain untouched. And if you are from PPP then dont worry the shahid's have laid the foundation for your mega Kick Backs. You can enchant the dead and do what ever you want.
"court orders do not apply to the president and prime minister". Wrong, Mr. Law Minister, that is in other countries not in Pakistan. In Pakistan things go the other way round and as our revered CJ wishes desires.
Naek said that running a government is the executive’s job, making a law is the parliament’s job while the court’s job is to ensure the implementation of the laws. And how exactly are the courts going to "implement" the laws if everybody (read PPP rulers) are above the law & do not implement the court's decisions?
Idiot
The Nations in the Past were destroyed as they have different laws for privileged and non privileged
Welcome to the new Pakistan. Where the elite, corrupt are above the law. This is probably the first country in the world where the govt mock its citizens by making special laws to protect their corruption.
Is this the promised 'roti, kapra and makaan' ? All that citizens got in last 5 years is LoadShedding, Corruption, Mocking-Judiciary, Price hiking and national debts.
I think we deserve this treatment because we voted this crooks.
A true Islamic republic of Pakistan and a nation based on Islam and Islam told us that no one is above the law but our Islam is now different and now every powerful is above the law. So many reasons to be proud of true Islamic republic of Pakistan. I think we have now achieved our dream to become a true Islamic state. All hail PPP, MQM , PMLQ and ANP for passing this bill of immunity in the first place. I am proud of all of you.
