Chief Justice Iftikhar Muhammad Chaudhry, hearing a suo motu case on Balochistan law and order situation, rejected the statement submitted by advocate general Balochistan Amanullah Kinrani and ordered him to submit another by July 31, a joint statement signed by the defence and interior secretaries and the Inspector General (IG) of Frontier Corps (FC) Balochistan.
The chief justice objected to the contents of the statement submitted in compliance with the court’s July 25 order and remarked that the statement showed no commitment over the missing persons’ issue. The attorney general, upon the bench’s objection, submitted an amended statement but the bench rejected it again and said that the IG FC and the interior secretary should sign it first.
“Get the document signed or produce your law enforcement personnel nominated in the FIRs and we will get them arrested,” the chief justice ordered.
Inquiring about when the no-go areas in Dera Bugti will be reopened, the AG replied that only armed people were not allowed in the area, and that local tribal disputes also impeded movement. However, the chief justice noted that restriction on mass movement should be removed, but maintained that the area should be subjected to an arms embargo with ‘not a single bullet should be allowed in the area.’
Citing Zakir Khan’s case, Noshki, Tutak and Sareena hotel incidents, the chief justice said that the court had provided the concerned authorities with all evidences. “We have reached the stage where everything has been identified. We are now providing them an opportunity,” he remarked.
On the other hand, Raja Muhammad Irshad, counsel for IG FC, rejected the claims that FC personnel were nominated in complaints.
The bench adjourned the hearing till July 31 after observing that the incomplete statement by the advocate general would amount to misleading the court.
The chief justice appreciated the report that the Prime Minister had formed a core committee over the Balochistan issue, terming it a good thing.
Public domain institutions accountable
Justice Jawwad S Khawja while questioning Raja Muhammad Irshad, counsel for IG FC, observed that bearing public criticism was part and parcel of being an institution in the public domain.
"Today we have gone through parliament debate in which certain remarks were passed against us but we never bothered it. We are in public domain and receive salaries from public exchequer. How can we say that we are not accountable." he added.
He reminded Irshad that the media reported many things which were unpleasant sometimes but it was the essence of free society.

@mahakaalchakra: Being disciple of CHANKIYA you have the cheeks to talk about human rights, Chankiya doctrine includes killing of innocent children, women and old who can't defend themselves, it says that burn the standing crop and deceive the friend. If you people let us live peacefully, you will live peacefully. If you will let go suppressed Kashmiri people there will be peace in whole south east Asia but that is not your aim. The Chankiya doctrine has affected your souls and blackened them, all of your neighbours are really fed up from your hegemonic designs. Rather it is balochistan and FATA your ruthlessness is evident, it is Bangladesh which is fed up of killing of her poor people crossing borders( to whome you liberated (: ) Burma is another country. Kindly get rid of your mean mentality of "lie, lie and so much lie that it becomes truth" isn't Chankiya said that???????
@Zaikam Yeah right. Then may be suo moto notice to terrorists will make them behave.
I think the security personal should remove all security given to the supreme court and CJ.
i wanna see police arresting army :)
Some of the comments directed to SC, shows limited knowledge friends have about this institution. It would be advisable to read it's powers first than write pathetic comments. Please don't be offended by this advise but absorb it.
@baloch lover:
Army lover with delusion level 7 on Jehadi scale.
@afzaalkhan: I don't think most people see it as wrong. They see it as a bluff.
Mr CJ first of all give exemplary punishment to your son by giving media fame statements you are trying to save your son,FC AND ISI men are endangering their lives to save Pakistan
God seriously all the indians commenting with pakistani names here is amazing so now SC is wrong again trying to hold FC for human rights violation.
SC is good at bullying the toothless government that doesnt carry a stick. The SC can fire an elected PM but i doubt if it can force an arrest of a subedar from the army or the FC, let alone the higher ranking officials. Reason? Both the FC and the Khakis have very loooooooonnnnnnnnnngggggg sticks(guns) and they arent afraid of using it against anybody. Anybody = pakistani civilians.
@Haider Ali: "CJ should be given credit for making the strong armed forces and agencies of Pakistan answerable who were ‘untouchables ever since the creation of Pakistan."
But has he truly made them answerable? Unlike the PM who actually came to court the DG FC will nto even come to court and of course he continues to disobey the court. HAs he been dismissed for contempt of court the way the PM was?
If the SC CJ is serious he should stop making political statements during the hearing. It is not publicity or popularity contest for political purposes. Speak through your decisions at the end of the case not wise cracks every day of the hearing. There should be meaningful and historic decisions that the nation has been waiting. We all know who the real killers are, now catch them and arrest them. Speeches are not the job of judges and leave them for politicians.
Should hush those that say the CJ is backed by the establishment.
Security people are not above the law. They receive salaries from public exchequer and accountable to the nation. Its high time that they should pay attention to the concerns shown by the Chief Justice before the whole country turns into Balochistan. Keep it up CJ the nation is with you.
FC should be removed from the province and instead Mr. CJ should be appointed there to look after law and order situation there. He and his fellow judges will do wonders. FC is just doing right with the terrorists.
CJ should be given credit for making the strong armed forces and agencies of Pakistan answerable who were 'untouchables ever since the creation of Pakistan.
Dear Chief Justice
IG FC has already called your bluff by not appearing in the Court and as opposed to Prime Minister who is dismissed for contempt there is no sign of any proceedings against him.
Fool me once shame on you, fool me twice shame on me!
really? and er exactly who would arrest them?
And what next Mr Chief Justice! you will arrest FC personal fighting terrorists and foreign rouge elements and they will back out demoralized like Karachi rangers and then look what happened to Karachi. Is your ego bigger then the lives of poor, hungry and load shedized people of Pakistan. Why can't you give us relief in electric city bills, petrol overhead charges, in commodity price control, to bring to task the people making fake medicines and above all to curb the rampant corruption of lower judiciary which has destroyed the social fabric as there is no justice for people, If not then your jumping from one tree to another is no use to dredged, suppressed people of Pakistan.
