The apex court’s been aggressive, and the ruling Pakistan Peoples Party (PPP) is considering clipping its talons.
The party is believed to be contemplating a constitutional amendment to curtail the Supreme Court’s powers to interpret constitutional issues, and set up a new federal judicial body to deal with such matters. The move to establish a separate Federal Constitutional Court (FCC), however, could exacerbate the executive-judiciary tussle.
The radical step, according to sources in the ruling coalition, was reportedly discussed at a meeting of the inner-most circle of the PPP, thought to be close to President Asif Ali Zardari, who would subsequently share it with his allies.
The proposed judicial body is likely to have the same powers as the Supreme Court when it comes to hearing constitutional petitions, like the one that caused the disqualification of Yousaf Raza Gilani.
The proposed amendment to the 1973 Constitution, likely to be drafted by the PPP’s top legal brains, will elaborate the distribution of powers between the Supreme Court and the new judicial body.
Curtailing judicial activism
The proposal, according to a PPP official privy to the matter, was first floated at a party meeting held the day Gilani was disqualified by the apex court, and some of Zardari’s allies suggested that he take an aggressive stance against what they thought was unacceptable judicial activism.
Zardari, however, advised his angry associates not to push for a hasty decision on this, and assured them that he would take the step at an appropriate time.
The meeting decided that the PPP would first try to curtail the energy crisis before what may appear an extreme step and spark hostile reaction not only from political opponents but also the legal fraternity.
The PPP and its allies have a two-thirds majority in both houses of Parliament that is needed to amend the Constitution.
Meanwhile, officials from the PPP have been dropping hints recently.
The latest one came from Information Minister Qamar Zaman Kaira on Wednesday when he said that establishing such a body was part of the Charter of Democracy (CoD)—a political deal between the PPP and opposition Pakistan Muslim League-Nawaz (PML-N) back in 2006 when the top leadership of both parties was in exile.
A similar statement was also issued in Lahore by Punjab Governor Sardar Latif Khosa a few days back.
The PML-N, however, said that while it recognised its commitment to favor the establishment of a constitutional judicial body, it would not support it at present for two reasons.
First, PML-N Information Secretary Senator Mushahidullah Khan said, the PPP must have done this at the beginning of its tenure four years ago.
“The timing makes it suspicious and not acceptable to us,” Khan said.
Second, the senator added, the move appears to have mala fide intent since it comes at a time when the executive-judiciary confrontation is at its peak.
Of the four major allied parties, at least two appear to be reluctant to endorse the government’s plan.
A senior member of PML-Quaid said his party would think about it when President Zardari shares the plan with its leadership, but added that supporting such a move might shatter the already fragile party.
Muttahida Qaumi Movement’s Haider Abass Rizvi was not forthcoming either. He refused to comment on what he called were ‘assumptions,’ saying the party would debate the plan at its decision-making forums if and when the proposal was shared with it.
Awami National Party’s Haji Adeel said his party would endorse the idea because he thought it was expected to relieve the Supreme Court from the extra burden it had to cope with.

What is un-Islamic here? The most important brick in the foundation of U.S. system of government_ the Not-so-British is that "Humans are Not Angels" i.e, In Poor system of Check-n-Balance even the best of human will be tempted to follow the "undeniable" ambitions of pleasure, respect, wealth or at-least power & control over the others__ one way or another. Now do we need a discussion to accept or reject this Natural Phenomenon? Probably not! To people who are asking or quoting Islam in the Pak Constitution must first understand & accept why we have the Distribution-of-Power among the Judiciary, the Parliament and the Executive. How do you quote Islam in this distribution? You Can't! Unless you claim the U.S constitution is Islamic and so you can borrow it's methods, which to some extant is!
Now why we keep running into Marshal Laws, Judiciary Coup, Political Corruption is because of lack of Check-n-Balance(ex, underpaid & poorly trained police or custom officer is easily bribed), Conflict-of-Interest(ex; the person who report or notice a fraud can't be the judge of it too, to prove his unbiased reporting, or the person who receive & count the money can't be the one who keep and maintain the client records___ he will fix his theft himself).
What we are seeing today is "thieves" are "calling cops" on thieves and so confused & helpless public is needlessly dragged into this mud for political gains, sadly at the cost of public too, who will be the looser in the end no-matter who wins.

Judges are very much government servents. They are drawing their pay checks from the government's treasury, budget allocations approve by the Parliment & the President. Even review of judiciary expenses are under purview of Public Accounts Committee ( PAC ) of the Parliment, though judges are resisting PAC review after the new found popularity in the right wingers./conservative section of society..
History is repeating itself. PPP has been the victim of Judiciary in the past and even it is today. General Ziaul Haq took charge of the country in the backdrop of a mass movement launched by the opposition parties, protesting the rigging of the parliamentary election in 1977. The government of Zulfiqar Ali Bhutto tried to contain the movement by force but that did not help. The movement turned violent and caused large scale destruction of life and property. General Zia seized the opportunity and overthrew the government. Bhutto was detained on the charge of the attempted assassination of Ahmed Raza Kasuri. The Lahore High Court found Bhutto guilty and sentenced him to death. The verdict of was challenged in the SC. The full bench of the SC gave a due hearing and by a narrow margin upheld the verdict. This judgment of the highest court gave rise to controversy, casting a shadow on the independence of the judiciary in Pakistan.
Let us revisit the distant past for a moment. Four years or so ago, the honourable judiciary was trying to reinvent itself by defying a dictator and his dictates. The underlying premise was that a dictator wielded undue influence and exercised unlimited and unquestioned powers. The concept in theory was fairly novel and praiseworthy. Very respectfully, I saw it quite differently. The overly chastised dictator was found to be a ‘dictator’ after approximately seven years of his rule...why that was so is my question. Do you see as I see a ‘disconnect’ here? All was well until the dictator exercised his constitutional power to question one of the respected members of the judiciary. By the way, the same honourable judiciary awarded the so-called dictatorial power to him.
@Hasan: A little correction in your comment is suggested here please. Judges are NOT Government/Public servants, for them it is said that they serve law. Supreme Courts' budget is not voted in the parliament and no one can ask question regarding their performance against the tax payers money they receive every year. To serve the people, there is this elected government and the public servants. What we are crying about that the Judges in Pakistan have started serving people instead of law.

Four years ago, this could have happened. Now it is difficult, masses will not accept. Instead of necessary amendments, PPP is trying to disintegrate the nation.
If the Parliament wanted to be supreme, it should bring an amendment in the constitution that every eligible citizen of Pakistan must cast the vote. It should set up a tribunal who call the citizens who do not cast the vote. Give the genuine reason and it is upto the Tribunal to accept or reject his/her reason and forgive or fine him/her. This way the corrupt people will be eliminated to come into the Parliament.
We must do something right away and since PML(N) has agreed upon it already back in 2006, it may not take long to get it done. Throw the bums out of that sacred building. The PCO judges should be tried for treason because they clearly over stepped their jurisdiction and set a dangerous precedent. This is judicial dictatorship.
Minimize loadshedding, write a letter to swiss court, make the constitutional amendment, get the CSF, pump in the money, delay elections as per constitution, hold official inauguration of Jinnah, Alai, Khan and Dubai khwar Hydro power stations, drop the cost of electricity - finalize remaining loan component of Basha, hold ground breaking, test fire 50MW gasified coal unit, hold a press conference in thar to show the development of 4 blocks that are almost ready, go into new election december 2013. Yes, easier said than done, but all points very doable individually.
PML N and PPP must follow the plan as agreed in COD and this is an excellent time to implement this. Our nation need a Constitutional Court and CJ can continue his plans running the Chaudhry Court till he retires or sent home.
Timings and suspecions aside, it does make logical sense to relieve SC of the workload to hear other pending non-constitutional petitions. However it should only be done with the support of all parties addressing their misgivings. Additionally it would be wise to select with mutual consultations, retired reputable SC judges with no party affiliations to be on the FCC bench. Difficult task given prevailing qualms but hopefully all parties will demonstrate maturity in the larger interest. This government is not going to last forever and the opposition may be on the receiving end on day, when their turn comes to power.
The Supreme Court of Pakistan does not want to try the president of Pakistan as they know about the immunity clause in the constitution. They want that the prime minister should write a letter to the Swiss auth not against the president but the co chairman of PPP. Now for this they may bring any amount of changes in the judicial system, the letter had to be written. Mr Zardari.
i think idea of division is not buyable but if they want the well get the support from allied because of followin reason:- a. party at karahci always want to be in power they will get the price for it. b. part at kpk his already bone in there mouth so thay will not speat in interest of state. c. than come the other they been given big bone in shape of deputy. so why they should be worried about pakistan.
A simpler solution is to impeach all PCO judges.

Courts are too busy in their political projections and left their own job to be taken over by Jirgas or suffering of the litigants. Their starvation for publicity has not done any good to the institution of the Judiciary. It will be worth while that constitutional cases should be dealt by a different courts. This will fulfill their desire of publicity and politics and at the same time people will also no suffer
The opposition (PMLN,. PTI, JI etc) is looking for a reason and a battle cry to march on to Islamabad. Try this stunt and they will have what they need for the final push. would be a mistake.
The current PPP gov doesn't have the moral authority to establish any kind of court. Whats next a separate court to hear cases of corrupt politicians? Who are they trying to fool? People supporting this step can you all comment on the current gov mismanagement and corruption and their credibility to implement such a system?
The Military now must flex its muscles and let know these corrupt rulers that they can not play with the country institutions for their personal greed and plunder
In an ordinary normal situation, the idea was not bad, to releive some of the work-load of SC. The same system is already working successfully in many countries. But in the prevailing circumstances, everyone will look at it with suspicion.
I only agree with this idea after learning PPP & PMLn both had this planned way back in time. Secondly, Our SC Judges' time is more valuable to take non-executive Public cases sitting on their tables for months.. Also an amendment is needed whan it's required because of it's urgency and can not be delayed because it's too late.
What if in our weak democracy a parliament would not have enough majority to do it for years and SC is stuck with this job for next ten or twenty years, only the people will pay the price of this delay & negligence.
6 months back I would have been outraged reading this. But right now, I think something like this might serve Pakistan's interest in the long run. We traded one kind of dictatorship for another. It has to be nipped in the bud.
This will be a very sad and un-welcome move. PPP should think first about the country and then their rule. All this to save wealth of one person in Switzerland!
This is nothing new. The two largest parties had signed charter of democracy in which creation of a constitutional court was agreed upon by Nawaz Sharif and BB. The current PCO SC is too busy in taking up new, political and manufactured cases and has no time for more imp constitutional petitions which are rotting in SC for decades. The current SC has lowered itself to a trial court and we do need an appeals court and constitutional court only to interpret the laws, a main function of typical SC. The current PCO CJ is already on extention and when he retires what is going to happen to his blind supporters?
This is high time for a comprehensive constitutional amendment to assert the supremacy of the parliament. The evidence of manipulation of the highest judiciary by the establishment in the past is so overwhelming that the judiciary cannot be fully trusted for its independence in the cases of political nature. The constitutional amendment must clearly resolve that specter. Please also make Quid-e-Azam Muhammad Ali Jinnah’s August 11, 1947 speech to the constituent assembly a part of the constitution through the same constitutional amendment. Do it before it is too late!
If your main aim is to hide your corruption and misdeeds, no matter what you do, how many courts you make, ultimately you have to pay the price. The government and its allies should focus on issues to benefit people rather than wasting their time & energy on these issues which are only going to ruin this already ruined country
Classic PPP mentality. Instead of eradicating corruption and living within the rule of law, PPP wants to destabilize the very organ that has been doing the Government's job. Pakistanis should realize that our illustrious President and his equally illustrious advisors are made of the same stuff that lost India to the British 3 centuries ago. We are going to lose Pakistan now.

Constitution is the holy child of the Parliment and voice of the masses. Legislatures must safeguard the constiution before a group of few ambitious government servents sitting as judges make the mockery of the nation's basic manifest and alter it as suited to their mischievous intentions.
Political parties must be united against all those forces ( khakis, Babus & so called Lords in black coats ) who want to deprive the people of Pakistan their legitimate right to govern.the country through the elected representatives. Please bring all the necessary amendments before its too late.
Writing letter seems to be easiest of all the options.
We need another coup if these corrupt rulers go forth with this plan.
