Illegal detention case: Hyderabad SSP in trouble for ignoring court summons

Officer was meant to appear with report but didn’t show up.

The high court issued bailable warrants of arrest for Rs20,000 against Hyderabad’s senior superintendant of police (SSP) for defying court orders and failing to appear.


Justice Gulzar Ahmed and Justice Imam Bux Baloch were hearing a petition by Zulfiqar Miran, a sub inspector of the Anti-Encroachment Police against the allegedly illegal detention of his younger brother and an activist of the Jeay Sindh Qaumi Mahaz, Imtiaz Mirani.

The petitioner maintained that on October 6, 2010 a heavy contingent of police surrounded the family residence in Shahbaz Colony, Qasimabad and asked after elder brother Ghulam Qadir Mirani who was not at home. The police took Imtiaz Mirani to the police station instead and he has been held in illegal custody since then.

On October 3, 2011, the Sindh High Court had ordered the SSP of Hyderabad to appear with details of the cases against Mirani. On Monday, a report signed by him was submitted by DSP Intezar Hussain Qureshi.

According to the report, 12 cases were registered against the accused under different sections but he has been acquitted in all of them due to a lack of evidence.

The report stated that five cases were still pending against the accused. They were registered at Hussainabad, Market, GOR, Qasimabad and Baldia police stations of Hyderabad district. The bench noted that in violation of its order passed on October 3, instead of the SSP, the DSP had turned up.

The bench, displeased with the defiance, noted in its order that although DSP Qureshi had brought the report, he gave no reason why the SSP had not come to court.

“It seems that the SSP has deliberately violated the order of the court and avoided attending court for no reason.” The bench adjourned the case till October 31.
