Chris Brown avoids prison as London court suspends sentence over nightclub attack

Judge Tony Baumgartner cited Brown’s guilty plea and mitigating circumstances when explaining the ruling

Chris Brown has avoided immediate prison time after a London court sentenced him for attacking music producer Abraham Diaw with a tequila bottle at a nightclub in February 2023.

The Grammy winning singer, 37, received an eight month prison sentence suspended for one year at Southwark Crown Court on October 26, according to the Associated Press. The ruling means Brown will not serve the sentence immediately, provided he complies with the conditions of the suspension.

Brown had faced up to three years in prison after pleading guilty in July to one count of affray over the incident at Tape, a private nightclub in London’s Mayfair district.

During sentencing, Judge Tony Baumgartner described the use of a glass bottle against Diaw’s head as dangerous, warning that the attack could have caused more serious injuries. Footage shown in court captured Brown being pulled away from Diaw after striking him twice with the bottle.

Despite the seriousness of the offence, the judge said a custodial sentence was not warranted in the circumstances. Brown’s guilty plea and other mitigating factors were considered, alongside his previous convictions. The judge also noted that the singer had maintained a clean record in recent years.

Brown left the United Kingdom after the 2023 incident. He was arrested at a Manchester hotel in May 2025 after travelling to the city for a concert. He had been released on bail of £5 million, allowing him to tour Europe and North America while the case proceeded.

The sentencing marks the latest development in Brown’s long history of legal troubles. He rose to fame as a teenager in 2005 and won Grammy Awards for his albums F.A.M.E. and 11:11 (Deluxe).

His past legal history includes a felony conviction for assaulting Rihanna in 2009. Brown has also faced other legal incidents in the United States and abroad.

The latest ruling concludes the sentencing stage of the London nightclub case, following Brown’s guilty plea earlier this year.
